If you don't provide a breath/sample you are automatically  charged with failure to provide, so in that sense he has been charged surely.?

Impossible did you suffer a head injury as a child or was it later? Btw the police could say he was falling over but without a breath sample or drug scrape have no evidence to charge him with either of the DDs.

begs the ? if Murphy is prepared to front it out with plod after a serious accident,how many times has the sports champion jockey fronted it with the so called jobsworth alcohol/drug testers on course,if its random testing maybe Murphy other top jocks  has a designated date/day when they no they will be pulled and now their free after that till given another date, surely the best answer for Murphy with his record would be to agree to be tested everyday,unless that already happens

I think the jockey could refuse to provide a specimen post an accident even if the Police suspected the jockey was driving eg the jockey did not admit to driving or committing the accident; was in the passenger seat (when the Police arrived) despite smelling of alcohol.

However, if proven, the penalty will be more severe eg a lengthier driving ban and mega cost (no issue here) imposed. Nevertheless, at that time of the morning of the accident, his breath smelling of alcohol and with a book of rides in the afternoon it can only prove unfavourably, and detrimental to his riding career with the BHA.
