It does not matter whether you are freelance or directly employed by the BBC. They should have no right to prevent you from freely expressing whatever view you wish within the parameters of the law.

Jack, because you are free to do something within the boundaries of the law, does not mean you are free to do it within whatever employment terms you have agreed to, contractually. If you join the civil service you have a right to strike, if you join the army, you give that up. Lineker agreed to specific terms relating to working for the BBC. It appears he has breeched those terms. I do realise that is a complex hurdle to get over from some (evidently).

I have no idea what the terms of his contract say and I doubt you do either unless you have somehow read it. The point is that the BBC should have no right to make people sign such contracts unless they are working in the fields of news, politics and current affairs.

Piers Morgan stated on his show that he spoke to Lineker and he confirmed that there are no such clauses in his contract.

I don't, and nor does Morgan. The BBC's intervention suggests there is.
Many elements in terms and contracts come down to interpretation anyway. A good lawyer can usually argue opposite interpretations, depending upon who is paying them. The key point is that just because something is legal, doesn't make it permitted under whatever terms he has agreed to with the BBC. |

Lineker confirmed to Morgan that there are no clauses preventing him from expressing his views. If that is the case and Lineker is punished by the BBC over this, then he should be consulting his lawyers and hopefully this will serve as a test case as far as the BBC guidelines are concerned.

Ironic really - Nobody is 100% if Gazza has breached the terms of his employment contract (I'd bet about 80:20 in his favour) and nobody is 100% sure if the latest distraction gimmick from the Tory party is legal or not (they estimate themselves that it's 50:50).

My view: 1 Freedom of speech and Human rights do not exist,they are a mirage. The Government's
behavior during Covid is proof of that.Rights are inalienable. 2. I've always been annoyed by the amount of time on MOTD being spent on Presenters drawing silly little circles around players etc. 5 minutes highlights of a match and 10 minutes of totally un-necessary 'Analysis' Football is not rocket science ffs! Proof of this is that tonight's schedule for highlights is 20 minutes. 3. What a presenter says on Twitter or whatever 'Social Media ' sites should be no business of their employers unless it is about them. The next thing that employers will be expecting is for presenters to post 'positive' items about their employers on social media! |

I don't normally watch Match Of The Day, but did last night. Could have done with a bit of commentary, but it was wall to wall excitement, which is more than you could say for Gary and his pals just having a chat.

Half way through I became aware that the crowd noise was phoney. Anyone else spot that? Poor, poor stuff.
The BBC have badly misjudged this in my view. That was pitiful viewing for a top, core show. They have made themselves look so bad. The difference between this rift and the Clarkson one is how Line Ker has garnered so much colleague support. It will be very interesting to see how it all pans out. |

I think the BBC have got it right. Sometimes you have to make a stand. Rules are rules and allowing them to be continually broken undermines the whole system. Personally I don't watch MOD very often at all but my advice would be to SACK THE LOT OF THEM, TODAY. Show some bloody courage and leadership. Start afresh. Make sure the new incumbents are fully aware of their position and that their bosses will not hesitate if they break the rules.
