Terimon, Hello and Make. Joined date is date you joined Bet Fair and not the forum. One can set up new account/other payment method which I believe gives new date.

Agreed makeyourownrules - you can write any terms you like but a clause where it says BF can void a bet at any time for any reason or no reason is not a fair term of the contract. A court will void unfair terms and so the bets stand.

difficulty Betfair will have in court is explaining the numerous cases where other punters have made palpable errors, but BF have not voided the race and given them their money back.

If Betfair think they can hang their defence on these facts:

a) price of 29 ws too high or
b) that the layer put up £21m to be matched and this was way above their ability to pay

(a) will be shot down in flames as horses get offered at silly prices by layers all the time on here in-running
(b) will be dismissed by BF's own TCs which indicate that a matched bet will still stand even if the liability exceeds the layer's ability to pay

BF on very shaky ground and unless they pay, this could see their demise as what serious in-running player will want to continue on their site if they can pull the rug whenever it suits them?

Thats true Arklearkle , i think anyone serious about taking this further wouldnt want thier main acc compromised in any way so a new acc seems very sensible .

Pedrobob you are very much on the right lines, I can assure you categorically this incident has been determined illegally. There are a great many other indisputable justifications that will make this decision look repugnantly untenable to any conscious reviewer.

possibly in this case the mr x who apparently put the price up by mistake might be liable but only up to his liabilty in terms of money present in his account, one doubts that this amount would be 21 million or that it would be fair that he should pay when the price froze inplay, all the race, I reckon
most on the side of the backers are under the illusion that betfair are laying the horse inquestion
and acting as a bookmaker?

fantastic, what makes you think the price froze?
And how is that relevant?
If your internet connection breaks down mid-race whilst you are trying to reverse a previous input error, do you seriously think that Betfair will accept that as an exuse to void the whole race and refund any losses you have incurred?

Betfair have a serious problem here. They have never voided a race under these circumstances before, even they have arisen on many occasions.

The race should have been settled like every other race.

It can't happen - I have tested it 100's of times. I have never found my account was negative.
So it doesn't happen. So either this customer had £600 million in their account or they have a special account.
If they have a special account then ok - but it was one capable of putting up a lay bet like it did.
So this is in the capability of the account and so within its intentions.

If and when this goes to court, I cannot see it going any other way but pay up.

If it were a special account then it is a big player - so if Laddies are at the other end of this, can you see a court letting this company off the hook?

No way - not any day of the week.

good luck zaynar i wish you all the best. i also backed the horse after 2 hurdles and at the time the fav was still going well and anything could have happened. had i lost i wouldnt have got my money back

i have just recieved a fax from  Cox Padmore Skolnik & Shakarchy of new york , thier advice was a refund would be almost impossible but a change to T&C is very likely to be upheld , also they would push for out of court settlment meaning a tin of high quality biscuits for evry acc concerned .

I hope all of this bravado leads to something. This company needs to be taught a lesson in customer equality at the very least.

I live in Cheltenham and have a good few solicitor friends with more than a passing interest in horse racing. I look forward to hearing their views tomorrow.

They haven`t elise. But there again they wouldn`t want to would they ? The trouble is the explanation so far is threadbare because whatever the scenario was,and there are lots of possibilities even if it wasn`t their own bot,one way or another they have screwed up.

As explained - I have tested the software 100's of times and I have never ever gone negative - it just doesn't allow the bet. So it doesn't happen.

so it is a special account. The site will not allow a £600 million liability.
Why is it not happening all the time. It doesn't have to be £600 million - it could be 6 pence -

Hands up whose account went negative - ever.
It doesn't happen so it has to be a special account.
You can hack into an account but you can't send it negative - you can take it down to zero but not a minus number.

So we have a special account and whose knows how they are operated.

the term bot is over used in the BF forum, in this case the bot refers to the automated software that serves the layer, backer prices , checks liability and adjusts the inplay price according to the risk, in this case there has been a complete breakdown in all these automated actions against one horse in the market.
