It's an exchange - palpable error does not come into this for one single second. If that is their defence in a court of law they would lose 100%, unless they are then happy to take on every single palpable that has been layed on here in the past - which would close them down indefinitely. There is 1.01 put up on every market on here (horses) as soon as the market is put up and many get matched - all of these are palpables are they not?
I agree if VDV was layed in the bookies ie wh/lads etc at the price they have their palpable error to protect them, but this is an exchange and that rule will not wash at all. |

What an absolutely boring argument......a brick dressed as a clown can see it was an error, both palpable and technological. Only desperate and embarrassing losers are trying to argue otherwise. SOMETHING NOT QUITE RIGHT WITH BETFAIRS HANDLING OF THIS, OPENED UP A MINEFIELD I THINK WITH ONE THING TO COME OUT OF IT SHOULD BE TO TAKE A LOOK AT PEOPLE ON COURSE BENEFITING FROM LAYING HORSES THAT HAVE FALLEN. Everyone who backed it thinks they're right to want their money or some compo, everyone who missed it or didn't back it thinks they're not entitled to anything. Those who didn't back it shouldn't be angry at those wanting their money, they should be angry at Betfair. If something happened to them they'd want people on their side but instead they side with Betfair who couldn't give a crap about any of you!
Those who backed it, go to court. You'll win, plain and simple. Those who didn't back it, don't get all snarky cause you're jealous. You should be by the side to make Betfair Fairer, not against them so this place never changes and you keep getting a **** deal. You could all use this to make this place better, in all aspects of betting. Don't miss your chance. |

philiplecornu - that's not correct. I don't think the squealers have a case for full payout.
However in Betfairs Rules it states 13. MISCELLAENEOUS . Betfair may, in the interests of integrity and fairness and at its sole and absolute discretion, suspend or void part of any market or the whole shebang in its entirety!!!! So it looks like they're covered, and quite right too! |

united, are you suggesting that all the key input errors made by customers in the past should be refunded? (including the £240k lost on Peregrine Falcon?)
btw, I clicked on the wrong horse today, took 6/1 on a fancied horse when the layers were busy at that instant hoovering up the 20's and 30's as it started weakening in the straight. My mistake, not asking Betfair to void the market.... or maybe you think I should? |

pedrobob - if you clicked on one thing and your bet presented itself on site as something else entirely, of course I don't think that you should be liable. And if you were, to the tune of £21 million, good luck to the counterparties trying to get paid. Betfair have indemnified themselves against their own demise through such a malfunction as happened with VlV.

No I don't pedrobob, and if he made the further mistake of laying VlV for £21million I shouldn't think he merited a refund for that either. But there was no-one standing behind the bet with a huge tank in this instance.

United, if you read Boycies blog, there is an argument for suggesting Betfair are sitting on a "huge tank in this instance" so i have understood your logic correctly - you are saying that the Peregrine Falcon backers should keep the money they gained by a palpable mistake of the layer in offering 1000 about a favourite out of the stalls.... but the VDV backers who backed at 29 should not? |

Betfair wouldn't go to the wall if a court instructed them to pay out the 21m simply because ultimately, the majority of it would be funded by one or more of the following
- new super-premium charge - new super-skimbot - change in the commission structure such as an increase in the minimum rate or decay rate - cost cutting across the board resulting in a worse site i.e. we will pay more than they will. Maybe these things are coming regardless but they'll be accelerated |

pedrobob - you keep comparing this case with others where customers won or lost against others, and the loser paid the winner. The losing account had £1,000 in it.
Although Betfair wouldn't go to the wall for £21 million, the priciple is the same whether the glitch figure is £600 million, £60.50 or £60 billion, so if Betfair lost this case in court, they may as well draw stumps anyway. |

Well seems like a lot of you will find out in the course of time.
Looks like steps are being taken to seek legal advice by most of the bigger punters who were on this horse. As I understand arrangments are taking place to form a group to test the decision by betfair legally. |

That looks a suitable nice round number to me. |

Zayner I dont think you are any the wiser from much of the foregoing. I dont believe the amount involved has anything to do with the rights or wrongs of the case. I dont believe 20m would be considered too much for a publically quoted company like BF to have to pay if they are found negligent in providing this service. I had no bet on here on the race but genuinely hope you take and win your case. Danger is you lose and have to pay their costs. From reading the thread I am surprised at the number of plants on here.

its unreal isnt it,people punt on here but dont trust the site or betfair,why bet on here just go to ****,if you dont trust what they tell you bet somewhere else it isnt hard,for me theyve come out and said weve nothing to hide and so take a look,the only thing theyve done wrong is letting this sole account go way above his account limit,the customer clearly doesnt hold these funds so betfair are the only option which i very much doubt will happen,punters who took that price knew something was up and were trying to profit from it,in court betfair will win ,its in the terms & conditions where they will get you and costly court fees for the punters,you really cant hope to profit from a software glitch joe korals or will wouldnt pay you so why should betfair.

Apart from the decimal point similarity to SP , no one has been able to explain the 29 odds . Any possibility the inputter was on the wrong horse , the volume being a seperate issue ?
Surprising the bot operator concerned has not been identified by the media . Sitting on a good book or payola from some of the tabloids , and they wont even need to hack his mobile . So far he / she/it has been very good about not cashing in his chips . Reckon he might do well financially out of this , and not even be charged for his initial ( assumed) potential lays . That equals winning , coming and going ! |
