Accused denies knowledge of scam

BY GRAHAM GREEN 8:32PM 23 JUL 2013

A MAN accused of involvement in a £5 million betting scam on Tuesday insisted he did not know the schemes were fraudulent.

Father-of-two John Brice, 40, a professional gambler from Hove, took to the stand on the sixth day of the trial at Lewes Crown Court, where he is on trial alongside John McCracken for conspiracy to defraud.

Jurors had previously been told twins Greg and Paul Spicer, from Brighton, and Lee O’Donnell, of Hove, had been convicted in June 2010 as part of the same case. Brice said he had been a lifetime friend of the Spicers and had accepted their offer of a job.

“They wanted me to open up a business account, which they would then run with the team of people they had in the office,” he said. “It was brochure mailing they were sending out. Because of racing regulations you can run only so many services so I had to open up a business account for a mailshot.”

Referring to the business, he said: “Never at any point did I think it was dishonest; if it was dishonest I wouldn’t have been involved."

Brice told the court he travelled to Coutts in London with Greg Spicer to set up a bank account under the name New South Holdings.

He also set up another bank account in 2006 linked to a mailshot in the name of Andrew Christie Investments. His solicitor, William England, started it off with a balance of £600 and ten days later it had grown to £170,000. Within months the sum was £800,000.

Brice said that until this campaign he had been getting £500 per week, as well as ten per cent commission on any balance, but that he had negotiated a 20 per cent commission on this particular mailshot which earned him in the region of £170,000. “I didn’t for one minute think there was anything untoward about this,” said Brice.

Asked what he thought about the Spicers now, Brice said he was “absolutely furious”, and felt he had been “shafted”.

Prosecutor Mark Cotter asked Brice whether he was worried after the Spicers’ conviction about his involvement with the business. He replied: “I wasn’t involved in the mailings they were convicted for.”

Brice and his co-defendants McCracken and Matthew Thole, a company director from Cardiff, deny the charges against them.

The trial continues.

racing post
By Jon Lees 6:31PM 24 JUL 2013

WARNED off punter John McCracken on Wednesday claimed he was still in contact with jockeys and trainers but refused to disclose the names of those that give him tips as he took to the stand for the first time in his trial for conspiracy to defraud.

In comments that will not be well received by the BHA, McCracken told Lewes Crown Court he used information obtained from trainers and jockeys to bet on horses to lose as he denied any part in a betting and tipping scam that used brochures bearing his name.

The Brighton-based 47-year-old, who is charged with conspiracy to defraud along with two co-defendants John Brice and Matthew Thole, was asked why he had given a no comment interview when he was originally arrested in 2011.

He said: "Simply, what I am involved in with jockeys and trainers is not legal. Every jockey and trainer is barred from speaking to me. I didn't want to implicate anyone. I didn't want to give any names whatsoever that gave me tips."

The BHA said on Wednesday night: "We are monitoring the progress of the McCracken hearing. John McCracken has been excluded from racing indefinitely."
