The first question means 'how did it happen that HF twice became a bankrupt?', not 'is it true that HF twice became a bankrupt?', i.e. accepts and re-states the FALSE premise of HF double bankruptcy. This libel is aggravated by the sarcasm within your use of 'amazing' (similar to Sally Bercow's use of a smiley face in her costly tweet re Lord McAlpine), by its expansion in your second question and more sarcasm in your final question. Your defence of 'I was just repeating what others said' would not allow you to escape liability. Again - forum users should NOT publish false statements such as asparagus' above which, in their ordinary meaning, damage Harry's reputation. |

It contains a number of false statements: notably the double bankruptcy calumny. (Apart from anything else, creditors don't meet at county courts, nor do bankruptcy orders get made after such meetings. The blog post portion you repeat is obvious rubbish.) As above, it is not true to say that HF had previously been made bankrupt, in Scotland or anywhere else. To repeat such a false statement is libel. Those who publish libels can be sued in defamation and ordered to pay damages. I don't think I can make it much clearer. |

Then I withdraw the allegation of double bankruptcy unreservedly. I have no personal knowledge of the matter, and as stated, was only repeating allegations made elsewhere. If they are wrong, I completely accept that as fact. |

As for your second sentence re repetition, at the risk of being boring and offering further legal warnings to forum users, here is what Justice Eadey said at para 44 of his judgment against Sally Bercow: 44. One of these is known as the repetition rule. Under that rule a defendant who repeats a defamatory allegation made by another is treated as if he had made the allegation himself, even if he attempts to distance himself from the allegation: Flood v Times Newspapers Ltd [2012] UKSC 11; [2012] 2 AC 273 para [5] and Gatley on Libel and Slander 11th ed (2008) para 11.4. |
