Germany is keeping him detained whilst they work out if they will deport him to Spain.

Quite shocking and shameful how it can even be possible that someone can be arrested for this kind of political charge in Germany.

In Belgium he was not treated like this. All political prisoners should be released.

But if you are a political prisoner, Germany is probably a good place to be......compared to say Russia, Venezuela, Pakistan, Egypt, indeed most of Africa, Vietnam etc etc etc.

In Scotland the an academic under similar charges will hand herself in later in the week to the police station. In Germany they dont mess about like that. Straight into custody.

They presumably have an arrest warrant - do you suggest they ignore it?

European Arrest Warrant issued David.

In Belgium he was not put in prison under the same type of warrant. Spain dropped the warrant.

In Germany he was arrested and it put in jail after the warrant was reissued when Puigdemont went on a trip.

In Scotland the lady is going in for chat at the local police station.

I am supprised at you supporting the Spanish/German/EU line on this Dave. European arrest warrant should not be used to stamp out political opponents.

Who is far right here? St Andrews University? The SNP? The Catalans? The Belgium justice system?

And it isn't the place of Germany to tell Spain who should and shouldn't be arrested. Imagine a foreign country deciding not to arrest one of our wanted criminals because they decided he was innocent or being persecuted before any trial had taken place.

Hopefully he goes back and everyone puts on their sensible heads again and sorts it out peacefully before it all kicks off again but he can't go inter-railing round Europe, thumbing his nose up at Spanish courts.

An arrest warrant is an arrest warrant.  I don't believe a country should allow anyone to be extradited without evidence of the extraditable crime, but that isn't the law.

pp and dave,

Do you support the Belgium or German position on this subject?

Countries have a choice how they react.

Both are EU countries. This is not an EU v Patriots issue. It is a right or wrong issue.

Dave,

You support the 'rule of law'.

The rule of law where: the UK, Spain, Russia, China, USA, Germany, Belgium?

You seem to have no sense of if something is right or wrong. No opinion. You just support the rule of law of any country?

He wasn't arrested because of freedom of speech or having an opinion!
He first held an illegal referendum, then after that he tried to illegally break the nation of Spain up!
It's not surprising the Spanish legal system have raised an eyebrow and want to speak to him on that little matter.

And this current fashion for lefties to call anyone who disagrees with them a fascist really got boring a year or two ago.

Can't believe I'm siding with Porcupine here, must be the joys of spring ;)

He tried to break up their ++++ing country and broke their consitution! What part of that is difficult to process?

It was a real thing and a real act, not an expression of an opinion. It's not that he printed a leaflet saying he wanted dogs to get the vote or something.

Are you on the wind up?

Insider Trader obviously the phrase "rule of law" is a general principle.  The "rule of law" in a dictatorship or an absolute monarchy is another consideration.  It is the most problematic issue in international affairs

The rule of law in this case concerns a valid arrest warrant between two democracies.  I gave my opinion on extradition earlier in the thread.  It appears in this case that there would be in any case be evidence of crimes being committed.

I assume that political asylum could be claimed in this case, if politics is the issue.

Haven't been keeping up with this. Why did he leave Belgium?
BTW he should have headed to Scotland where wee Jimmy would have seen him safe.
The rhetoric amongst the Nats here is that he's being arrested because he sought independence.
If that were true I'd support their stance but as it aint true I don't.

Pretty sure it was as JC described. Usual spanish summer of someone wanting their independence. Usually gets sorted behind the scenes with extra budget shovelled their way but this time there was a face off with neither side backing down, him calling a referendum that wasn't sanctioned and then the Spanish government wading in with batons and alsatians.

Not great and someone somewhere should be trying to quietly get the two sides round the table and to move on but it looks like that's not happening. Maybe he's just spent too much time on the Costa del Sol and thought arrest warrants were meaningless.

The charges of 'sedition and rebellion' do not exist in most countries. It is the language of totalitarian states.

Truely bizarre any civilized person can side with the Spanish state on this.

If you want to start encourage violent protest and fighting arresting politicians is the way to do it.

When has it ever worked out in the long time for a state to start arresting politicans? In Ireland in the end we got Good Friday agreement. In South Africa in the end the prisoners were released. In the end both the USSR and the Nazis in Germany fell.

In what way is the best way to solve this to start arresting politicians and sending in paramilitary forces on the general population?

The Germans will make sure he'll only be put on trial for defrauding the public with his illegally held and expensive referendum, don't worry Happy

Since there's a real danger that he'd flee you can't really release him on bail, can you? Heard German prisons are neat-o anyway.

Just checked and among others the likes of Canada, Ireland (has been re-written to be anything undermining the authority of the state), UK (sedition by an alien at least), USA etc all have laws against sedition. Germany has a law against incitement of the people, which is obviously similar.

Oh how pathetically symbolic of global lefties; `we can call you any name we feel suitable but if you call us the same name, you`ll be dragged out and shot at dawn` And this as he discusses Free Speech! My word, lefties do entangle themselves trying to argue in joined-up ideas! The risible and shameful behaviour of a nobody, who`s on the wrong side of history and all things good, decent and, most of all, right!

UK has no laws like this.

'High Treason' is completely different. The last person tried for this in the UK was in 1946 due to actions in WW2. To compare these to actions by Carles Puigdemont and Clara Ponsati is disgusting.

It seem unlikely the academic lady from St Andrews University will be handed over to the Spanish state by the UK.

I really am surprised that liberal minded posters like Edy and PP are so pro this action by Spain and Germany.
