the supreme court can order should it so choose that no electoral college discussion and vote can take place until the eligibility issue is resolved one way or another. therefore the supreme court actually has a lot of sway in the matter.

Don, the Electoral College does not convene as a unified group. Therefore, the Supreme Court can hardly order them not to convene. Electors in each state all meet at their respective state capitals on the first Monday after the second Wednesday in December to cast their votes. The votes are then counted and certified in a joint session of Congress on January 6.

The Supreme Court interprets the constitution it has no authority to tell the Congress what to do.

since canary is still online i thought i would clarify my position on this. spent some time looking into it.

i believe obama will eventually show a birth certificate stating he was born in hawaii. this may not happen, but i now believe it will.

all but one of the court cases attacking his eligibility will be denied, because they all hinge on the birth certificate and the fact it may or may not state place of birth as hawaii. obviously if he produces said ceritificate and it says hawaii they will be thrown out.

i believe these court cases are a distraction which will be disproven, and this will come out in the mainstream media, in order to hide the real and only legitimate court case of donofrio.

poker player Leo Donofrio's case is the only solidly constructed case. it argues that obama, mccain, and calero are all ineligible, as none are natural born citizens under constitutional law.

so there is no doubt a case exists.

donofrio's lawsuit is the only one worth following and keeping up to date on. the other cases are actually irrelevant, and are in fact just a hinderance to his case.

No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.

this shows the express intention of the founding fathers and the constitution to ensure that the president is a natural born citizen. with the addition of the so called grandfather clause - "that a citizen of the united states at the time of the adoption of this constituion" - they are accepting that they themselves did not meet the criteria of a natural born citizen, seeing as it wasnt possible for them to do so at the time since they also held british citizenship. that is the only reason this clause is in there - so one of them could be president under the constitution's rules.

by virtue of his father's kenyan, and therefore british citizenship, obama also held british citizenship at the time of his birth and therefore whilst he is a citizen of the united states (assuming he didnt renounce that!) he is not a natural born citizen because dual nationality precludes natural born citizenship as evidenced by the grandfather clause. under british law a child to a british parent born abroad holds british citizenship. this was the case for obama.

there has never before been a president who did not have TWO parents holding us citizenship. this is because the constitution does not allow it.

who is they? who's responsibility is it to ensure he is eligible? the secretaries of state are bound to by constituional law.

they have broken the law by not honouring their obligation, hence donofrio also has a lawsuit again new jerset secretary of state Nina Mitchell Wells, who confirmed that she simply assumed his eligibility given that the party had nominated him.
