His ,I was getting strangled defence,seems weak,given he opened the door freely then closed it,then speeded up. If fans were hanging out of his window,you could understand flight or fight. Why haven’t the cps ,charged him with attempted murder,then let the court and jury decide. They normally love over charging. |

A judge can tell the jury to find him not guilty if the evidence doesn’t reach the threshold of attempted murder,if it does,the jury can then decide.
They charge for easy wins ,in most cases,to save jury trials,as courts can’t afford it or have time. But in high profile cases ,they usually go for the biggest charge possible,then adjust along the way. They’ve aimed low here,he clearly will plead guilty,so no trial. The public,surely would want a trial. Everyone is asking,why did he do it ,what was his intent,logic. They tend to love over charging in big cases to look strong,to clamp down on crime,to deter future crimes. People posting on Facebook,get charged with inciting riot or terroism, Someone near a riot,nicks a bottle of water,gets 2 years in prison. This guy,had loads of time to assess the situation,300 yards,but still carried on ,trying to push gently his way home,then ploughed 79 down cos they banged on his door.plus on a closed road. Why didn’t he park up,200 yards before,and think,I ve no chance of getting home yet,I ll come back for the car. Why would anyone attempt to drive through city centre when it’s full and roads are closed. The wife’s got a lot to answer. Love,drop me on water street,I’m getting my nails done, Can you walk last 100 yards love,no drop me at the door. We don’t know,and never will cos,no trial. Moment of madness excuse,fight or flight excuse,looks weak,given he queued for 300 yards gently pushing his way through crowd. They clearly thought. Having seen some footage I don't think the attempted murder charge is an open and shut case. He seemed to be driving at about 5-10 mph. If you are trying to kill and injure people he'd have driven a lot faster, and fear of personal safety may have led in part to his actions. It's clear that his actions on another day could have led to deaths. I don't know the letter of the law myself, so it depends on that, and I think on the letter of the law he probably is guilty. Being high on drugs is no defence ofc and he is clearly guilty of all the other charges.

By contrast, Erin Patterson in the mushroom triple murder case in Australia is clearly guilty with intent imo, and a much more wicked person than the driver in Liverpool

You don't need to prove intent to be guilty of murder. Suspect for attempted murder it's the same.

If you punch someone in the face and they subsequently die, then that is murder. But if you punch someone in the face and they end up in hospital it's not attempted murder.

Panic, they were trying to get him out of the car and he knew he’d be fkd, he lost it imo and those split second decisions when your in panic mode can seem very odd but he just had to get away to save his life, yes it’s wrong and he is guilty imo but it’s not normal that he would do that, put yourself in a situation where they will kill you if you get out and you need to flee, it’s a strange one and sad its happened
