there is no arguement, the horse MUST be disqualified. They have leeway for 1lb of overweight, anything above that results in instant disqualification.  That's why the idiots at bookmakers should never try to play steward and pay out before the weighed in signal.  It's their own fault - pure greed, only want you to have your winnings to play on the next race. Unlucky for Betfair punters who will be looking at a negative balance.
