Reading today's RP it appears the blame is being put on this lad's shoulders, which,I think is totally wrong. After watching the race live and numerous reruns ,the following has to be asked. Also his past misdemeanours are a separate issue as circumstances were totally different.
Were the first flagman's instructions clear? No
Was confusion created by the second flagman? Yes
Could the flagmen have made a better job of their intentions?Yes
As a race watcher did you know what was intended by the flagmen? No
Will the stewards pass the buck to Danny?More than likely
As danny said in his interview with Luke ,you are travelling at 35 mph, short straight at Newters,2 to jump and a guy is inside the rail waving his flag signalling something is wrong, but what?
Forget his previous, its not like a criminal's string of burglaries ,as there is a huge element of doubt here.
Interesting to read the forum's response(Forgetting any financial involvement in the race)

If the stewards suspend him again, which will be a disastrous decision,it will cause serious damage to his career,so it becomes a very important issue.
In a court of law the jury has to be positive in their conclusion, there must be no element of doubt, which there most certainly is here.

I think a ban would be very harsh given the circumstances. It's not your normal case of a jockey not knowing the track, or the rules.

Hope they let him off, bad enough for him that it was on the big stable gamble.

They should of used a different coloured flag to indicate that there was an incident ahead and to be extra cautious. It seems so outdated the system that they are currently using.

Just to balance the discussion a tad.

If Danny Cook's actions were understandable, then why did EVERY other rider ignore his lead and jump the hurdle?

Jockeys are normally sheep and just 'follow my leader'.

Ask yourselves why they were able to make the correct decision?

Loper has a point. Maybe the poor lads head is totally shot over previous incidents. But the instructions were still unclear and I don't think too much blame should be thrown at the jockey. Banning him for a long time would shoot his confidence to bits.

Surely if they meant for a hurdle to be missed, markers would be put up?

And Danny seems the only one to have heard this "Guy shouting"...

So they were closer to the flagman.
Report Fairbet? April 25, 2010 10:32 AM BST
To lay the blame at Danny's boots is a little unfair, as the racecourse staff and personnel were not quick enough to act to make the situation clear. Why didn't they doll the fence off with the arrows like they normally do instead of what seemingly appeared to be rushing a decision. This obviously caused confusion. Nevertheless, Danny is partly (and a big part of it imo) to blame as firstly, he should have jumped the fence as it wasn't dolled off. Secondly, why run towards the incident they were waving him away from with the danger flag? Why didn't he go around the fence the other way? Danny made a wrong decision but he was not helped by the lack of organisation by the racecourse staff. Just my thoughts.
Report Diamond_Joe_Quimby April 25, 2010 10:32 AM BST
Why would they doll off the fence, it was meant to be jumped.

The boy was clearly upset when Luke interviewed him I wouldnt want to be in that situation flags, shouting ,screens and trying to control a horse coming to a hurdle ,the system of communicating to jockeys clearly needs an overhaul
Report Diamond_Joe_Quimby April 25, 2010 10:36 AM BST
The rules are clear imho.

If a fence is to avoided, markers are placed in front.

No Markers, fence must be jumped.

Just watched again loper, you were right ,the horse was not in 3 0r 4th, mid div.but only seemed to slow down after going round ,he was still travelling, then slowed right down as if pulling up,probably confused too.
Reading all the replies there is certainly confusion, and once there is confusion you cannot convict.

So what was the purpose of the man waving the flag positioned on the inside rail?
Report RipleyCat April 25, 2010 11:01 AM BST
I had a nice bet on it but in no way do I blame the jockey. Only people to blame are those with the flags in their hands. What were they doing and were they actually needed in this instant as the stricken horse was effectively on the chase course?
Report whodareswins April 25, 2010 11:02 AM BST
The whole affair should be investigated. There was a flagman, who is a course official, waving before the hurdle. He was waving the flag from a position behind the rails that indicated the jockeys should ride away from the rails. Had he not done that it is very likely Gaspara would have jumped the hurdle and possibly won. The course official should have been asked why he was waving a flag from his position before the hurdle as part of the stewards inquiry, and before Gaspara was disqualified.
It's totally unfair to blame the jockey for following the instructions of a course official.
Report Lee Ho Fooks April 25, 2010 11:02 AM BST
So did the enquiry find Danny 100% to blame and everyone else blameless then? If so racing still has a big problem.
Report thebeg April 25, 2010 11:03 AM BST
in all seriousness the stewards should take responsibility for this farce
Report unbiased April 25, 2010 11:04 AM BST
The fact that he has go to London and attend the enquiry says it all.
Report logikal April 25, 2010 11:22 AM BST
Whats the odds on him taking the worng course and not making it to London??

What I find a bit strange is how he said the man waving the flag was shouting go around go around at the start. Yet no other jockeys heard this.

Though in todays article it appears someone has shouted not to jump the hurdle, though he says it wasn't another jockey, and he doesn't know who it was.

That bit seems a bit odd to me as he's changed his story. Think if he'd have just said look the guy was waving the flag and I wasn't sure so for safety reasons i went around on a course that I could see. Which I think would have been fair enough as there could easily have been another jockey layed flat out at the otherside of the hurdle or something else.

FFS its very simple. If there is a hazard on one side of the course you position the flagman on that side to alert the jockeys and signal that they should go the other side. What did NA do? they positioned the flagman on the outside therefore the jockeys went inside, which is logical. The track officials are very lucky imo that there wasn´t a stricken horse/jockey lying on the inside of the hurdle where they were guiding the field.

Whoever was responsible for the flagmen should be held accountable not any of the jockeys.
Report sandown hill April 25, 2010 2:07 PM BST
I was at the meeting and backed Gaspara. When they were putting the screens up around the stricken horse there was real confusion amongst all of the officials on course. At one stage they dolled off the last hurdle which was passed the incident before realising that this was pointless.

All i can say is it is far easier to blame the jockey than to admit that the reaction to the incident was amateurish if not shambolic. But that would mean the stewards admitting that they and there systems were at fault, which is never going to happen.
Report in hell April 25, 2010 2:08 PM BST
a flagman was standing by the stricken horse pointing at danny cook not to go that way . danny cook ignored it
Report hippodrome April 25, 2010 2:09 PM BST
No - it's even simpler than that.

Black and yellow chevron markers (pointing in specified direction) in fence/hurdle is the specific trigger to bypass the fence/hurdle.

The chequered flag complements that process but the chequered flag by itself specifically means "possible hazard ahead".
