In the terms for qualifying for PC it has one criteria of 'account in profit, over the lifetime of the account'.
If you were a winning player at sports, but had other losses on your account (e.g. Poker or Casino) that meant your account had not shown a profit over the life of the account, I presume the account would not qualify for PC, is that correct?
Just wondering, as it would seem rather unfair (to be polite, lol) to be charging a customer with a heavily losing account - so in debt to the site - a Premium Charge!
Betfair hide behind their own terms and conditions and the customer service response is simply take it or leave it.
They don't realise that there will come a day when there will be somewhere else to go.

The terms and conditions are hidden away now even deeper within the bowels of www.betfair.com

Line 1 states the following:
The Premium Charge only applies in respect of bets placed on the Betfair Exchange and it does not apply to any bets placed on other Betfair products.

It is still impossible to claim that an account is in profit, if it clearly isn't.
The criteria is quite definite in the terms - The 'account' must be in profit. If a customer does not have an account that shows a profit, they don't fit the criteria.
The rule you quoted says that the charge will only be applied to exchange bets, not the same as trying to claim a losing account is in profit.

betfair obviously have to protect themselves against a PC payer conveniently losing all their weekly profit to the same opponent in heads up poker week after week after week.
