Judge isn't thick obviously. But she has ' judged ' this case very badly imo. She has literally based everything ( to the letter )against the law books, and has been absolutely deaf and blind to the evidence presented by the prosecuting council.
Globally she has been heavily criticised. She got it wrong. OP should be facing a sentence related to murder.

Report brigust1 • October 21, 2014 9:44 AM BST
Not serve a day, surely. Will appeal for sure on that sentence. Watch this space. Even the pro's couldn't agree.
Report Facts • October 21, 2014 9:45 AM BST
Has to serve one sixth of the sentence, before parole is considered. So potentially could be out of prison after 10 months !
Report guinness2dear • October 21, 2014 9:47 AM BST
I don't agree with the 'experts' saying she has given a balanced sentence. As the most he could have got was 15, then a properly balanced sentence would have been 7 and a half.

Report brigust1 • October 21, 2014 9:49 AM BST
As the commentator just said 5 years is a heavy sentence for culpable homicide. Must appeal because this looks heavy handed. One man cannot be used as a weapon against society because they have awful gun crime figures.
Report Facts • October 21, 2014 9:50 AM BST
I agree, 5 years can be seen as too lenient. The judge made a case of showing mercy to OP.
He didn't show Reeva much mercy did he ?
Report brigust1 • October 21, 2014 9:51 AM BST
Had she set amuch lower sentence then appealing wouldn't be necessarily considered butthe length of this sentence forces his hand.
Report i_agree_with_nick • October 21, 2014 9:52 AM BST
Could be out after 10 months. This isn't parole as such - remainder of sentence is under 'correctional supervision'.

The ANC womens group have been supporting the family and flying them to the trial. On top of the fact OP has been paying them on a monthly basis because they had no money. This is not a done deal. In my opinion. Seems likegroups like the Women's ANC are putting pressure on the courts for sentencing of famous people, gun crime and crimes against women. There is lot more to this but there you go. There but for the grace etc.

Report mafeking • October 21, 2014 4:24 PM BST
a circus from start to finish

manslaughter is when you punch someone, they hit their head on the pavement and it ends up killing them. no intent to kill but you've caused their death

what it isn't is firing 4 shots through a door into an enclosed space where any reasonable person would know death or serious injury was a near certainty
Report Facts • October 21, 2014 6:29 PM BST
Yep. Justice hasn't been done, or been seen to be done by today's verdict.
A guilty of murder verdict would have been correct imo. The fact that the judge saw it as manslaughter is one thing. But she could have sentenced him to 15 years. 5 years, where he only has to serve one sixth, before likely release on parole is a travesty.makes a complete mockery of the system. The evidence presented by the prosecution, was, to the most part ignored by the judge. She seemed intent on basing her judgement solely on historic cases as per the law book.

"I knew he was banned from competing till 2019 but it could have been overturned..... I would have imagined he'd have a strong case"

Not really, because he was sentenced to 5 yrs, so surely no question they would overturn it within that time.  But the way this has gone nothing would surprise me.  Justice has not been done and he has got off very lightly indeed,  and if he did ever return to sport I'm sure there would be a lot of hostile feeling against him, and rightly so.  And even this 10 mths in jail looks like being a soft option on the hospital wing away from other prisoners in his own cell.  The whole trial was a sick joke !  And that old woman judge !!

Prosecution appealing...

The judge's critics have argued that dolus eventualis includes the possibility of meaning to kill one person and ending up killing another, our correspondent says.

This is what annoyed me at the time, the judge seemed to be of the logic because he couldn't foresee it was Reeva then he's not guilty where as the natural interpretation is that the person is irrelevant and he could foresee the possibility of killing someone even if it had been an intruder and proceeded anyway
