she won 3.4m..........got her then husband, 2 sons, stepson and husbands nephew to sign ticket (6 signatures in all including her own)........said she did this to avoid gift tax..........she gave 380k to one son, 300k to the other, 100k to nephew............the stepson denies claim that he was offered 200k...........her husband (his father) has since died..............stepson wants 1/6 of win = 560k...........he says he got a letter from lotto stating congrads, you own a share of winning ticket........

predict the outcome lads..............will he get 560k?..............this is a belter...........winning the lotto and ending up fighting...........what a world.

Yes,seems simple.
Case for the Ma to be done otherwise for "tax evasion" as it was a predetermined attempt to defraud revenue if the end result was for people to get nothing.

He agreed he had not contributed to the €12 cost of the winning ticket

He was left nothing in his father's will.


So how did he come to own the house that his dad and stepmum lived in?

Would that suggest that a deal had been done?

Also, the gifts given to the other family members were not 1/6th shares, so would that indicate there was no intention that the money was to be split equally and the amounts given were 'gifts' rather than equal shares?

Years ago there was a case locally -syndicate won the lottery -modest amount -it was probably lotto plus.Anyway a member of the syndicate hadn't paid up for 6 weeks-within an hour of the draw he was knocking on the door of the syndicate organiser and pushing the back money into his hand.
The legal advice to the syndicate was pay up or pay legal fees-they paid up.
I make the son 4/11.

If it was genuinely a syndicate why did none of the others get a 1/6 share?

While the woman might have been an unreliable witness I cannot see why the judge overlooked that fact.

It seemed to me the woman was trying to save her relatives money by evading gift tax.
This seems to have turned the judge against her.

The fact that the stepson put nothing to the purchase of the ticket is relevant to me.

I suppose the law of unclean hands kicks in here

Kind of agree with your sentiments Wildman,fair point nothing towards the ticket.
From what i know of it the woman was trying to do her best and was "advised" by a financial advisor from lotto to go that route.
Think the stepson after getting the house to himself is a little greedy to have brought her through the courts looking for another payday.

Think ye have the wrong end of the stick, she didn't get on with the husbands family, I'd say she's a proper hag. After the husband died she tried to rob 50grand out of his account, this is a woman sitting on over 3 million. I'd say this was the main reason the judge sided with the son, along with her constantly changing her story, I don't think he mentioned signing the ticket in his judgement. 300grand has been set aside for legal fees, I hope she appeals and loses another 300
