The Coolmore and Ballymore stud farms in Tipperary have denied any implication they were underpaying their staff.   
   
The Coolmore and Ballymore stud farms in Tipperary have denied any implication that they were underpaying their staff - following a prosecution on Tuesday by the National Employment Rights Authority for alleged breaches of employment law.

This week's proceedings at Clonmel District Court have been adjourned until November - as the stud farms mounted a constitutional challenge to the Joint Labour Committee system of setting wages for agricultural workers.

A spokesperson for the stud farms told RTÉ that Coolmore and Ballydoyle employ a team of highly skilled, highly trained and highly regarded personnel.

She said that NERA had complained about the payments to what she called 'a small group of employees'.

She said that in each case, the employee had earned substantially more during the year in question than they would have had they been paid the rates set down in the legally binding Joint Labour Committee system.

Coolmore and Ballydoyle said they took great pride in their people and want to be able to reward and pay them accordingly.     
The spokesperson said it defied belief and made no sense why an organisation like NERA should pursue organisations like Coolmore and Ballydoyle for paying 'in excess of JLC rates'.

The alleged breaches involved in the prosecution by NERA included refusing to provide records to a NERA inspector, and failure to pay wage rates and Sunday premiums in accordance with the JLC Employment Regulation Order governing agricultural employees.

If there's even a question about rates of pay at Coolmore, God help anyone working at other establishments.

NERA are an absolute joke to deal with,like most governmemt agencies have no grasp of day to day business,common sense or real life.The amount of layers of bureacrucy one has to go through when dealing with this agency is intense-as u may have gathered i don't exactly have an impartial opinion of this agency-I spent two full weeks of my life filling out forms for this agency and because it is so in-adequately run never even received a reply-not that i was looking for one.

id imagine its just mugs trying to cause a fuss. look at siptu, no matter what any worker is payed its not enough, while their chief exec gets payed 100s of thousands

Regardless what you think of nera, the question is why would they refuse to provide records if everything is above board?.
Nothing ever changes, modern day slavery still exists for many who work within the racing industry.

It is fairly obvious this crowd went in throwing their weight around and were shown the door.They have now responded in this vindictive way.

Well it's their job to enforce non-compliance and a lot of their investigations are often based on tip off's often from employees whom have been underpaid. Ballydoyle if they are any sort of business, should  operate in the correct way.

Had a case a number of years ago where the inspector thought we were underpaying a lad who filled petrol and brought the money into the shop staff, he believed that he was in a position of authority as he handled money.
coulnt work the tills but thought he was management, go figure.

jlc rates are a joke, local offy up the road can pay €8.65 to their staff on sunday yet i have to pay €12.44, thats a 43% wage rate difference for two different shops selling the same product. how can that possibly be fair?

Nobody answered the question, if they had nothing to hide then why didn't Coolmore co-operate and provide the records requested?, a simple request!, by refusing to do so suggests to me that they've plenty to hide and a lot more might be uncovered.
Racings bully boys now trying to bully an organisation that was formed to stop this type of exploitation, yet some crab NERA, why! I wonder?.
Or have we a hidden agenda at work here?, people who are employers themselves???.

Is this about Underpaid, overpaid employees??

Or about non compliance with laws re showing how much they pay each of their employees?

NERA inspector's passport out of date, so they wouldn't let him in.

Reading between the lines in would say that the employees are paid a rate higher then the jlc requires but are not being paid the sunday premium on that rate.
overall they work out better then being paid the basic rate plus the premium but thats not the point according to nera.
a friend of mine was strugging in his business last year, called the staff in and said we need pay cuts or redundancies, the staff all agreed to pay cuts but nera stepped in and demanded that the jlc rates be applied or else he would be prosecuted. so 2 staff were laid off.

a classic case of the agency hurting those who they proport to protect.
