The horse was inconvenienced, and his running was affected. Had Ben won he'd have been deemed a runner as the horse had not been inconvenienced (it won) or negatively affected the result. This was explained by one of the stewards.

the problem with this rule is that it has introduced a scenario (which is unknown at the time until the horse does what it does) where everyone who has backed the favourite in essence has a free bet on the favourite, whereas everyone else has paid. this is a less fair situation than the misfortune experienced by the backers of the fav, when the fav does something to hinder its own chance of winning. and the guy from whirlpool who thinks they are protecting the majority from unfairness, is actually creating unfairness for the majority because those who are opposing this horse at 3s or whatever it was, are the majority. muppets
