Report domino14 July 15, 2018 6:58 PM BST
Alan's Dad has never backed him. Not a yard I can remember riding for tbh, but I knew it was common knowledge in the weighing room, that his Dad preferred to have his horses elsewhere and has never given Alan any money, and actually made Alan buy the yard off him. He actually has a shrewd former Irish trainer working for him, so you wouldn't know who trains the horses.

@Mrcombustible

I've made no sweeping statement at all.

I have said I think it was the Farrier and the jockey, and doubt Alan involved.

On the other hand you make a statement saying he fully knew what was happening.

Alan was of course acquitted of all charges, so if he did know he surely would have been found guilty.

It's worth noting the farrier no longer does the yards or Jonjo's horses, the two main yards he worked for at the time of the incident, and the jockey has subsequently been warned off in regards to laying of horses with a jockey.

Alan on the other hand, has not had any issues regarding his character as to whether his horses are trying or not.

Hindsight if anything would suggest it was more than likely Alan was an innocent party in my opinion.
Report mrcombustible July 15, 2018 7:50 PM BST
The reason Alan was acquitted of all charges was that there were going to be 3 trials. Rodgers,F Lynch,S.Lynch Fallon,Williams,Sherkle was the first trial, the CPS lost their bottle with the collapse of the first trial and never proceeded with trial 2 and 3.
Trial 2 involved the layers , Miles Rodgers associates and trial 3 was Alan Berry. Alan could never have been found guilty as his case did not go to trial.

There are things I cannot say on a public forum but you are very very wide of the mark

Adrian has lived and breathed racehorses from the day he was born. From the early days going racing with his Father dandy (David Nicholls) where he received his nick name trotter from the lads in weighing room because he trotted behind dandy’s every step. At the early age of 15 Adrian went to ride in Norway after finding a loop hole in the age restrictions. After 3 months off racing he was then teamed up with Barry hills at his legendary stables as stable apprentice, whilst there for a year and a half learning a great deal. Adrian was then offered a role at kingcleare stables as stable apprentice to Derby winning trainer Ian Balding this was a great learning curve learning about all aspects of racing within 3 years he rode out his claim in the Ayr gold cup. Adrian continued his upward rise in the weighing room riding multiple group and listed winners, including two group ones this was the highlight of a career that expanded over 19 years riding all over the world riding winners in 12 country’s along the way. All the time learning different ways off training and horse care. Adrian now embarks on his dream role as a trainer putting all theses skills to use along him is Clare his wife was born into racing in Ireland her father and brother former trainers.  Clare was apprentice to Adrian’s father David learning from him and key member of staff Ben Beasley she has a vast understanding of all aspects of horse care and is Adrian’s right hand lady.

August Update …
WEll we started the month off hopefully as we mean to go on, as the horses are running well and in great form.

Lances’ 3 last runs have been very solid and he seemed to enjoy the ladies touch in the Amatuer race under a lovely ride from Harriett Lees

Xtara went to Hamilton where had to run with a  6lb penalty, he ran avery solid race in defeat. Xtara was a very game second and will relish the step up in trip next time out.

Vivernus has completed his 6 weeks rest and is now back inthe game, he has been the best patient so we are hoping its all systems go from now.

Th eback end of this month to the start of next we are hoping to get some more of our two year olds out, but no rush as its all head of them

Hillside Girl Update
Published: 30 September 2004

– Reasons for Disciplinary Panel findings published
– O’Sullivan and Jewett to answer further charge
– Absent witness called to Portman Square

The reasons for the Disciplinary Panel’s findings following their enquiry into the running and riding of Hillside Girl are published today. The evidence heard by the Panel did not support the charges which alleged that Alan Berry, the trainer, Paul Bradley, the jockey, and Stephen O’Sullivan and Dale Jewett, former employees of Alan Berry, had conspired or connived together with a view to running Hillside Girl when they knew the filly to be lame. The charge that Berry had attempted to mislead the Carlisle Stewards was dismissed by the Panel and another charge against him was withdrawn. However, the Panel did find Berry, O’Sullivan and Jewett to have breached of a number of Rules and the reasons are reproduced in full on the Jockey Club’s website.

The Jockey Club has also confirmed that it intends to proceed with charges against Stephen O’Sullivan and Dale Jewett in relation to the Panel’s finding that they ‘knew that Hillside Girl was sufficiently lame that it had little chance of winning or being placed in the race at Carlisle and that they used that information, which they acquired by reason of their positions as a stable employees of Alan Berry, in the interests of bets laid by them in the “win” and “place” betting exchange markets.’ These charges allege that both O’Sullivan and Jewett were guilty of a corrupt or fraudulent practice by using such information.

This matter was not concluded at the initial hearing due to the Panel accepting that because the Jockey Club had only notified O’Sullivan and Jewett shortly before the start of the hearing of these particular alleged breaches, the parties concerned should be given a further opportunity to consider and if necessary bring forward relevant evidence in respect of the remaining issues connected with this charge, namely whether or not use of the information amounts to a corrupt or fraudulent practice.

The Jockey Club has written to Stephen O’Sullivan and Dale Jewett and asked that they submit their response to the charge, in accordance with Appendix S of the Rules of Racing, within 14 days of receiving the Panel’s full reasons, as published today. No date has yet been set for a Disciplinary Panel enquiry to consider the matter.

The Jockey Club have also written to William Keenan, a former stable employee of Alan Berry, and informed him that he is required to attend a Disciplinary Panel enquiry in light of his decision not give evidence at the Hillside Girl hearing. William Keenan gave two statements to a Jockey Club Investigating Officer but subsequently failed to attend the enquiry itself. A provisional date of 14th October has been scheduled for the Panel to consider, under Rule 6 of the Rules of Racing, whether his failure to attend was ‘without reasonable cause’.

30th September 2004

Notes for Editors:

1. The enquiry arose out of the running and riding of Hillside Girl (IRE) in the Father’s Day Novice Auction Stakes 2.10pm race at Carlisle on 15th June 2003.

2. Following the enquiry, the Disciplinary Panel imposed the following penalties:

Alan Berry
Breach of Rule 220(vii)(b) – £400
Breach of Rule 51(i) – £1500
Breach of Rule 54(i) – £250

Stephen O’Sullivan
Breach of Rule 241(i)(b) – £1000

Dale Jewett
Breaches of Rules 241(i)(b) and 220(viii) – the Panel has decided to withdraw Dale Jewett’s Amateur Riders Permit from 8th October 2004 and to order him not to reapply before 16th January 2005.

3. The reasons and findings are reproduced in full on the Jockey Club website: www.thejockeyclub.co.uk .

4. Stephen O’Sullivan and Dale Jewett are alleged to have breached Rule 201 (v), by being guilty of a corrupt or fraudulent practice in relation to racing, namely using information known to him by reason of his position as a stable employee at Mr Berry’s yard, but not publicly available, that HILLSIDE GIRL (IRE) was or was suspected of being lame in its left fore and therefore had little chance of winning or being placed in the Father’s Day Novice Auction Stakes (Class E) at Carlisle on 15th June 2003 in the interests of bets layed by him in the ‘win’ and ‘placed’ betting exchange markets.

5. William Keenan is required to appear before the Disciplinary Panel in relation to Rule 6 of the Rules of Racing which states: “No person who has been requested by or on behalf of the Stewards of the Jockey Club to attend an enquiry or hearing of an appeal under Rule 178 shall without reasonable cause fail or refuse to do so. This Rule shall apply to a person who has ceased to be bound by the Rules of Racing where, in the opinion of the Stewards of the Jockey Club, he has material information concerning events whilst he was subject to the Rules of Racing and the power of the Stewards of the Jockey Club under Rule 2(i) shall apply in respect of any breach.”
Report 1830 August 20, 2024 5:40 PM BST
Alan Berry, the trainer, and jockey Paul Bradley both face the loss of their license and with it their livelihood when they appear at Portman Square, London, today to answer serious charges relating to the running and riding of Hillside Girl in a race at Carlisle in June 2003.

Also facing charges in relation to the same incident are Dale Jewett, an amateur rider, and Steve O'Sullivan, a blacksmith.

Hillside Girl was pulled up before halfway in the controversial race at the centre of the case, having drifted from odds-on to 21-1 on the betting exchange Betfair prior to the off.

The Jockey Club's disciplinary panel will consider whether Berry, Bradley and O'Sullivan were guilty of, or conspired with each other, for "the commission of a corrupt or fraudulent practice, namely ensuring that Hillside Girl, a filly which was known [to be] or suspected of being lame in its left fore and therefore of having little chance of winning or being placed, should run at Carlisle on 15th June 2003 ... in the interests of bets laid in the 'win' and 'placed' betting exchange markets."

O'Sullivan, an employee of Berry at the time, is also charged with hindering a Jockey Club investigating officer, while Jewett is accused of successfully laying bets on Hillside Girl when he knew she was unlikely to win.

Three days have been set aside for the hearing, which is not expected to conclude until Tuesday evening at the earliest.
