I don't think the issue is whether he would have won (almost certainly not). The worry is that, at 35 mph and several horses wide of McCoy, he couldn't have been sure that he wouldn't win.

he made a mistake..he thought the half-furlong pole was the winning post (dont know wherther they even had half-furlong pole's when Newnes was riding)...nothing to do with whether he was sure he wouldnt win or not
..and anyone that thinks it made more than, say, a neck difference (ie no way would he have won) is barking imo

Next Stop came from out of the pack to get into second, this after starting off racing up the stands´ rail and Billy Newnes stopping riding in the final furlong. Given the route the filly had to take, she did well to finish where she did. The stewards held an enquiry and were satisfied that the rider had obtained the best possible place, and they noted his explanation that, due to his current level of fitness, his legs had become fatigued in the closing stages.

Newnes got banned in the 1980's and on his first ride back at Ascot rode the two year old filly Chili Girl for Mrs Heinz. The same John Dunlop stable also had the very hot favourite for which there was fortunes. Unfortunately for the fav backers Chili Girl was still in front inside the final furlong but luckily the wobbly legs cut in on Chili Girl and the fav went on to win!!!!
