If a jockey can sue for his winning percentage back in this (ridiculous) situation is there any difference in a punter suing the BHA for return of winnings due to the winner not being disqualified?

Please assume for the sake of argument that the first statement is true and he wins.

Didn't the courts go over the heads of football authorities to introduce the 'Bosman Rule'? Couldn't they also go over the heads of the racing authorities? Just because a rule is introduced to a sport doesn't automatically mean it is sustainable in the court of law.

iwould be amazed if soumi dosent bring them to court!

one smack of the whip and they decide not to pay him?[smiley:crazy]

facking daylight robbery, the whole BHA organisation needs looking in to, should be locked up in 'straight' jackets!

If an employer introduced a rule you can have say 5 cigarette breaks a week and someone is seen on cctv going for 6. They then decide to fine this employee his weeks wages, would the courts not come down on the side of this person? For me the penalty, as with Soumillion, far outweighs the crime.

You have ovelrlooked something here

You would have to PROVE that the whip was the sole reason the horse won and that my friend is impossible.
