When I was first emailed about the above last month, I clicked on the portal at terms.betfair.com, and I'm sure that the conditions stated that I was to be considered to have generated total charges equal to 40.4% of my lifetime gross profits. I therefore assumed that I had a (very small) buffer before I started paying the new PC.
It turns out, though, when I go to the old PC portal that I am being charged this week, and the portal at terms.betfair.com now states that I am considered to have generated total charges equal to 40.0%.
Yeah, I did too. I never paid the original PC, but I used to log in to the portal every now and then to check on my total charges %age. At some point a few months ago the £1000 allowance disappeared (though, of course, I never used it).

I was just under 10% and therefore was thresholed at 50% when first emailed. I knew I could get my comGen to over 10% by the time Super PC came in and I did but mythreshold is still 50%. It therefore appears to be set for life.

(BTW, I wasn't able to check the "terms" page after my initial acceptance always got a server error page..)

It's quite simple really - you've never received your allowance but you're deemed to have used up your allowance paying premium charge you didn't pay during a time when you weren't liable for PC (or, indeed, during a time when the PC did not exist at all) as it is deemed that the PC has always existed and those who become liable for PC have always been liable for it.

Contrarian: the terms.betfair.com site still has your buffer details as of the 18th July.
they were a bit sneaky in that they gave you figures of what your buffer would be if the PC came into the effect the following week, and they updated this every week up to the 18th.
the original buffer was based on 27 or 20th June i think.

It seems that there has been a retrospective change to the terms and conditions in that the point at which the PC rate is calculated is 20th June, but it was not announced until 28th June. I am sure that Betfair would lose a legal challenge regarding the PC being charged now and henceforth. They are entitled to close the accounts of those attempting to get the money back, but that is a separate issue.

W/ regard to the retrospective element, bf's argument will be that the charge applies to a bettor's _continued_ usage of the site--that with the charge having been announced and a week's grace granted, the customer is free to withdraw his winnings and bet elsewhere without paying a tittle of extra charge.
Otherwise the scope for any future charge is allowed for in bf's standard terms and conditions.

Now I'm not a lawyer but pp's last post seems to be an awfully large stretch from a layman's point of view. Also unless he feels some strong desire to act on principle on behalf of all punters, why not just cut his losses and walk away from BF ?. I doubt whether the PC he has paid to date in aggregate would be compensated by any win he might have from any such action, in terms of the time and effort and perhaps further cost risks he would be taking in pursuing things legally. But each to his own I suppose.

I can't access the terms.betfair.com site any more - it says I'm not affected by the charges! The old premium charge portal seems to have the proper figures though. Very underhand of them to also take away the £1000 premium charge allowance that used to exist...
