When I was first emailed about the above last month, I clicked on the portal at terms.betfair.com, and I'm sure that the conditions stated that I was to be considered to have generated total charges equal to 40.4% of my lifetime gross profits. I therefore assumed that I had a (very small) buffer before I started paying the new PC.

It turns out, though, when I go to the old PC portal that I am being charged this week, and the portal at terms.betfair.com now states that I am considered to have generated total charges equal to 40.0%.

Did anyone else notice this?

I had a £1000 allowance that has dissapeared aswell.

Yeah, I did too. I never paid the original PC, but I used to log in to the portal every now and then to check on my total charges %age. At some point a few months ago the £1000 allowance disappeared (though, of course, I never used it).

We'd better hope that someone had the foresight to save the page when they clicked on the acceptance of the terms and conditions. Extremely underhand tactics by Betfair.

I was just under 10% and therefore was thresholed at 50% when first emailed. I knew I could get my comGen to over 10% by the time Super PC came in and I did but mythreshold is still 50%. It therefore appears to be set for life.

What really gets me is that I would have played this week totally differently if I'd thought that I didn't have the buffer.

doesn't this paragraph mean the rate is ajustable ?

"It is possible that your lifetime commission generated to gross profits ratio will change to the extent that your applicable Premium Charge rate will require adjustment. Should your rate change, we will recalculate as if you had always incurred the Premium Charge at the new rate. If your rate has decreased (eg if your lifetime commission generated to gross profits ratio increases from 4.9% to 5.1% - moving you from a 60% rate to 50% rate), the Premium Charges you ‘overpaid’ when being charged the higher rate previously will be used to offset future Premium Charges. If your rate has increased, Betfair will notify you directly and give you at least two weeks’ notice before the increased rate takes effect. You are entitled to seek review of your Premium Charge rate at any time. "

My comGen is 10.12%. My Total Charges was last week set at 50.09%. It may come down for next week though.

For the purposes of introducing a change to the Premium Charge rate that applies to your betting, we will assume that you have always incurred the Premium Charge at the prevailing rate. For example, if the Premium Charge rate applicable to your betting increases from 20% to 40%, we will assume that you have always paid Premium Charges at 40%. However, as explained in the “Calculating Potential Charges” section above, this also means that for some customers, some or all of the £1,000 allowance against the charge will have been used in order to offset hypothetical charges paid. Assuming hypothetical charges had been paid prior to introduction of the charge has the effect of reducing the amount that customers would typically incur.

just been on phone to premium team and they said I have used up my allowance already - I can only suspect the "terms" page was misleading as the allowance was certainly higher than the amount I will end up paying for last week.  (BTW, I wasn't able to check the "terms" page after my initial acceptance always got a server error page..)

I had the disappearing allowance thing happen to me when I moved onto PC.  It's quite simple really - you've never received your allowance but you're deemed to have used up your allowance paying premium charge you didn't pay during a time when you weren't liable for PC (or, indeed, during a time when the PC did not exist at all) as it is deemed that the PC has always existed and those who become liable for PC have always been liable for it.

All completely fair, transparent and above board.

with the super premium charge set for life, betting via another persons account could look an enticing prospect for some people.  Not honest me of course, I am trying across the road.  Its proved better so far than paying 60% here.

Contrarian: the terms.betfair.com site still has your buffer details as of the 18th July.

they were a bit sneaky in that they gave you figures of what your buffer would be if the PC came into the effect the following week, and they updated this every week up to the 18th.

the original buffer was based on 27 or 20th June i think.

It seems that there has been a retrospective change to the terms and conditions in that the point at which the PC rate is calculated is 20th June, but it was not announced until 28th June. I am sure that Betfair would lose a legal challenge regarding the PC being charged now and henceforth. They are entitled to close the accounts of those attempting to get the money back, but that is a separate issue.

Premiumpayer, I wd be interested in how you get on.

W/ regard to the retrospective element, bf's argument will be that the charge applies to a bettor's _continued_ usage of the site--that with the charge having been announced and a week's grace granted, the customer is free to withdraw his winnings and bet elsewhere without paying a tittle of extra charge.

Otherwise the scope for any future charge is allowed for in bf's standard terms and conditions.

Talk about bf selling the shop, though. The people who were its most ardent admirers now seem to be suing it.

Now I'm not a lawyer but pp's last post seems to be an awfully large stretch from a layman's point of view.
Also unless he feels some strong desire to act on principle on behalf of all punters, why not just cut his losses and walk away from BF ?.
I doubt whether the PC he has paid to date in aggregate would be compensated by any win he might have from any such action, in terms of the time and effort and perhaps further cost risks he would be taking in pursuing things legally.
But each to his own I suppose.

For me it was the opposite. I never checked but assumed I'd be started on 40% but am actually on 40.9% so I have been given a buffer.

I can't access the terms.betfair.com site any more - it says I'm not affected by the charges! The old premium charge portal seems to have the proper figures though. Very underhand of them to also take away the £1000 premium charge allowance that used to exist...

1st time checked i had been put to 40.7% 2nd time 40.4% then week premium charge was taken bang on 40%
