Home Secretary Priti Patel has defended plans to deport 50 people to Jamaica on Tuesday, after more than 170 MPs called for the flight to be halted. She said those on the flight had been convicted of "serious offences" carrying sentences of more than a year.

She was bound by legislation to deport them, she said.

But shadow home secretary Diane Abbott said the move was unfair as some had come to the UK as children and "have no memory" of the country of their birth. It comes after a leaked draft of the Windrush scandal report said the government should consider ending the deportation of foreign-born offenders who came to the UK as children.

Ahead of the flight on Tuesday, protests against the deportations took place on Monday evening outside Downing Street. Meanwhile, a legal challenge that was launched against the flight by a firm representing its potential passengers has been refused by the High Court.

Duncan Lewis Solicitors had argued that the flight's passengers include people who are "potential victims of trafficking, groomed as children by drugs gangs running county lines networks and later pursued in the criminal justice system as serious offenders".

The flight from the UK to Kingston is due to leave on 11 February and is expected to include a man who arrived in the UK aged five.

In the Commons, Labour's shadow home secretary Ms Abbott said there was "widespread concern", saying the deportation flight "constitutes double jeopardy because the persons have already served an appropriate sentence for their crime". She added: "Many of the proposed deportees came here as children and have no memory of Jamaica."

Ms Patel said every person on the flight had been convicted of a "serious offence and received a custodial sentence of 12 months or more". Therefore under legislation introduced by a Labour government in 2007, she said, "a deportation order must be made".

The government has received a blow to its plans to deport about 50 people to Jamaica after one of two legal actions to try to halt the scheduled flight succeeded.

The court of appeal made the ruling in an emergency out-of-hours hearing on Monday night, ordering the Home Office not to remove anyone scheduled to be deported from two detention centres near Heathrow on the 6.30am flight to Jamaica on Tuesday – “unless satisfied (they) had access to a functioning, non-O2 Sim card on or before 3 February”.

There has been a problem with the O2 phone network in the Heathrow detention centres since last month so many detainees have not been able to exercise their legal right to contact their lawyers.

Akeem Finlay, of The Waldrons, Croydon, has been jailed for six years for the attack at West Norwood station on a 20-year-old man. Finlay, and two other men, followed their victim to the station at about 6.45pm on September 6, 2011.

The trio barged through ticket barriers as they stalked the man, attacking him as he sat on the platform waiting for a train. They thrust a bottle into their victim’s face, leaving the man, who was 20 at the time, with wounds that have scarred him for life.

They are attempting to link it to the Windrush deportation review. Which was leaked and recommends 13 as the cut off I believe. There is of course only an extremely tenuous link to Windrush, as none of these people moved to the UK under Windrush and they have all been convicted of serious crime. Many people have been deported to many countries under this legislation, people like Lammy are only interested in these cases as they are black.

What's hilarious is that the legislation used to deport these people was brought in by New Labour.

This incident follows the bloke who was prevented from being deported by passengers on the plane he was on. Then later it emerged that the criminal they were trying to deport was a gang rapist.

When hand-wringers and bleeding hearts get involved, always get ready for a balls up.

I understand some had sentences of just over 12 months (one of the conditions, I believe), but the deciding factor was none of the naughties that were deported were British ie did not hold a British passport. It could have been an oversight on their part not becoming British or they were too poor to become one.

Is it a great loss for the majority eg drug dealers, etc? Absolutely not, regardless of whether Jamaica had not been their home for many, many years. The UK do not want people of that ilk either. Shame this does not apply to British Passport holders born overseas.

The law is being followed. Who's to say whether supplying class A drugs is a better or worse crime than GBH. That's why the threshold of a year's bird is what counts. I'd argue that the case of the con who left his home country when he was five is unlucky, but my understanding is that he done two separate stretches. What we reap, we sow. He was on just now saying his childhood was being taken away. Erm, no, that was you wanting to be a gangster, fam.

I think The UK must abide by International Law eg an individual rendered stateless and with a British Passport and born her must be allowed to return to The UK regardless of crime. However, an individual in a similar predicament but not born here whose application to return to The UK must be denied or at least challenged in the courts.

I agree anyone who was a repeat offender of the same crime deported yesterday have only themselves to blame - with family or not. They could reapply to return after a period eg 10 years after they have shown repentance.

I think only 17 were deported to Jamaica as a few were reprieved (for now). But, none were British Passport holder; here as a child, but repeatedly doing illegal dodgy activities does not immune them from deportation under a legislation introduced by Mr Lammy's Party in 2007.

These are not petty criminals, done for stealing a loaf of bread here, they have each been given over 12 months sentance.

If we can get rid of them from these shores then the UK will be a slightly safer place to be.

Any one convicted of a serious crime (12 month sentence suggest it is) and is from a foreign country should be deported.

the home office have now agreed to take another look at, at least 8 of those on board,so maybe the home office might think some shouldn't be on the plane
who no,s they may all end up getting deported as as their already in detention no ones in danger

everyone has a sob story to their crimes. Prison is full of people who it wasnt really their fault, mixed with wrong crowd and so on.

they did the crimes (serious ones too, we are not talking speeding tickets here or stealing a loaf).

Maybe other foreign criminals will think twice before they do these crimes knowing it will lead to deportation.

I think the hammer killer was not on the plane and is still serving life.

But he was an example of a violent criminal that had been told he would be deported to Jamaica but was allowed to stay, and then did the murder.

Lloyd Byfield, 48, admitted stabbing 26-year-old Leighann Duffy 14 times after breaking into her home in Walthamstow, east London, in September 2014.

At the Old Bailey, Byfield was told he would serve a minimum of 26-and-a-half years but may never be released. The judge also told the court the authorities failed to deport Byfield after he committed earlier crimes.

During the hearing, Judge Nicholas Cooke said the murder could have been prevented if the Jamaican national had been sent to his homeland after he attacked another woman with a chisel and was jailed for 30 months for burglary in 2005.

He told Byfield: "You were to be deported but, for reasons that have never been explained to me, that was never actioned and you remained here able to kill an innocent woman."

The Home Office said Byfield was one of about 1,000 prisoners released without being considered for deportation over several years which the then Home Secretary Charles Clarke apologised for. Mr Clarke was later sacked as home secretary.

Byfield was released in 2005 and absconded after a deportation order was pursued in 2007.

I don't know the law exactly akabula….

but I remember it at the time, it was done for women.

We don't allow anybody who has committed a sex offence to come into this country, for the same reason.

Mike Tyson was not allowed to come, although he had served his sentence, that disappointed me.

For Ms Abbott to say the deportation caused "wide spread concern" was clearly untrue, and to use  "double jeopardy" as a reason not to deport clearly was an emotive misjudgement as deportees were non-British repeated offenders of odious crimes. I believe these repeat offenders must always be repatriated to their country of origin regardless including with/without a family.

And, none of the deported was related to "Windrush" either.

Many years ago my brother spent eight weeks in a regular jail in Brisbane awaiting his deportation for overstaying. He never moaned about it and was quite grateful not to be charged for the flight home.

Fully support the idea of deportation of serious criminals but I also have a nagging doubt about the ability of our civil servants to get it right in every case instead of ensuring the first example is a cast iron case of guilty parties.

He said there must be ‘urgent action on the farce that judicial review has become’.

The Tory manifesto promised a review of the judicial review process – a pledge that has unsettled some in the legal profession.

Cummings said to officials that the support for the court ruling among MPs and hacks ‘shows they still haven’t understood what the last few years has been about, the country outside London is horrified but rich London is cheering the lawyers’.
