The sad thing is Yasmin Alibhai has yet to understand why Asians were expelled from Uganda, and Kenya whilst other ethnic minorities could remain. Even the Chinese with their dominance presently in several African countries are still welcome.

Constructive dismissal can't happen without first using the organisation's 'grievance/complaints' processes. A couple of days ago it was confirmed there were no grievances formally raised. He's gaming the system angling for a bigger pay off, simple as that.

Try to resolve the matter with the employer
If an employee is concerned with a situation at work they should first consider raising the issue with their employer informally. Some issues can be resolved quickly through a conversation with a line manager or other appropriate person within the business.

If an informal approach does not work an employee has the option of raising a formal complaint (also known as a grievance). This should be done in writing and would make the employer aware of how strongly the employee feels about the situation, while also giving the employer the opportunity to resolve it, initially by inviting the employee to a formal meeting to discuss their concerns.

If an employee has not made genuine efforts to resolve their concern with their employer before resigning, this can make it more difficult at a later stage to claim that the employee has been constructively dismissed by the employer.

Yes Dave. If they have a case for constructive dismissal. The point is that if you don't give your employer the opportunity to act on any grievances then the case is more difficult to prove (theoretically).

I'm quoting directly from acas, not a random website and have direct experience of these types of issues (not at this pay grade though).

You must me a moron if you think he has actually been bullied out of one of the cushiest jobs in the country !

These cases rarely go to tribunal, I'm sure his legal advice includes the awareness of this.

If you have a genuine grievance this needs to be raised with someone neutral like a line manager or people experience. Not the person perceived to be the perp (obviously).

He will have taken legal advice and has left stating that he was constructively dismissed.  Even on your Acas link the advice is not to work notice, but to leave immediately.  You can be pretty certain that if this goes to law the discussion will be about Patel's conduct and whether this amounted to constructive dismissal and nothing else.  He will indeed get a bumper payout as will the treasury adviser sacked by Cummings. This is the price of voting for cants who have no respect for the law.

dave, I'm not struggling with your link. I'm well aware that employees should resign if they feel they have a genuine case of constructive dismissal. It's not that much of a nuance to be fair. If the claim is genuine you're expected to follow your employer's grievance procedures where possible. His legal advice, perhaps more pertinently his own experience of running the home office will tell him that the overwhelming likelihood is that he won't be required to prove it.

patel had to resign for having off the record meetings at which she was attempting to funnel international development money to the israeli defence force. when government ministers have legitimate meetings the spooks sweep the room to check for listening devices, she went rogue and this didnt happen leaving herself open to blackmail by those she met. imo, she shouldnt be an mp let alone in one of the great offices of state.

Why has this become so acceptable? Surely children will forever be spelling words incorrectly? What's the point in the english language if those in influential positions just show a complete disregard?
