Judges rule Parliament suspension is unlawful

Boris Johnson’s suspension of the UK Parliament is unlawful, Scotland’s highest civil court has ruled.
A panel of three judges at the Court of Session found in favour of a cross-party group of politicians who were challenging the prime minister's move.

The decision overturns an earlier ruling from the court, which said last week Mr Johnson had not broken the law.
But it will not immediately affect the current suspension of Parliament, which started in the early hours of Tuesday.

This is because no order has been given by the court to cancel the suspension ahead of a full hearing at the Supreme Court which starts on Tuesday of next week.

In a summary of their findings, the Court of Session judges said they were unanimous in their belief that Mr Johnson's decision to suspend was motivated by the "improper purpose of stymying Parliament".

They added: "The Court will accordingly make an Order declaring that the Prime Minister's advice to HM the Queen and the prorogation which followed thereon was unlawful and is thus null and of no effect."

Their full judgment will be released on Friday.

This was an egregious case of a clear failure to comply with generally accepted standards of behaviour of public authorities. It was to be inferred that the principal reasons for the prorogation were to prevent or impede Parliament holding the executive to account and legislating with regard to Brexit, and to allow the executive to pursue a policy of a no deal Brexit without further Parliamentary interference.

After The Sun reported that No 10 sources had attacked the ruling by Scottish judges, suggesting they are politically biased, Nicola Sturgeon responded: “This is pitiful, pathetic and desperate from No 10.”

Joanna Cherry QC added on Twitter: “Disgraceful slur on judicial independence. We chose the Scottish courts because we are Scottish & they weren’t on holiday.”

what i think now is that the law broke the law,but the law must protect itself and its the laws duty to uphold the law to protect itself,in other words the law my turn a blind eye to the unlawful act to protect itself.which in itself is unlawful,now we all know where accountability rests but if i am correct Boris is innocent of any charge against HIMSELF.

the problem is accountability,and the media seems to be silent about who was responsible (even though we all know who it is).
it will be swept under the carpet very quickly and its my guess that the powers that be will place a curfew on media reports,but rest assured there is bedlam behind the scenes as civil servants on all sides try to dilute the very serious situation.

If we are going to be ruled by judges, than get rid of the politicians.

If we are going to be ruled by Brussels then get rid of our politicians and judges.

I don't really care - you will always be ruled by very unpleasant and probably incompetent people. But we could at least get rid of a few la(w)yers of them.

the supreme court will decide ,but the problem is if it goes against THE APPEAL it means the law was broken,and the Queen will end up right in the center of controversy that follows.the last monarch to be charged with treason was King Charles the first.

The leaked document wasn’t out of date. This isn’t project fear. It is a sober assessment of what could happen.

No deal is not ‘vanishingly inexpensive’ or a ‘bump in the road’. This is only a part of the chaos and long term damage our country would suffer. We must stop this.
