got caught on camera 31/01/2017
reecievced the caution on the 31/03/2017.
refused to pay speeding fine on the 14 day rule and had now got a court appearance on the 12/09/2017.
the hearing is to clafify whether i plead guilty or not guilty to speeding.
i rung up the court and spoke to a clerk who was very helpful.
i explained about the 14 day rule and he checked my file and said that the police have it on file that the caution was sent out on the 06/02/17.
he told me to tread carefully and it was down to me to prove that the police did not send out the caution on the 06/02/2017.
how can i prove that?

What's the date on the caution?

And you might need the date stamp on the letter.

The actual Caution notice?

any letter accompanying the Caution?

The envelope?

^ Because none  add up if you ALSO RECEIVED the Caution on the SAME day 31/03

stamp dated 28/03
letter dated 28/03
got letter 31/03
caution say i was caught speeding on the 31/01/017 and that they aim to prosecute
that is why i aimed yo contest it.
the court clerk said that the police had it on file 06/02/2017

the clerk doesn't appear to have been very helpful after all then.
it doesn't matter when the police said they had it on file as being sent out,
you received the caution on the 31st, as is clear.

is it worth going to court to dispute it.
i have 3 piont on my lisence .
got done at the place.
got caught on camera on 31/01 and 20/03
got both letters on the same day.
paid the fine for the 20/03 and am disputing the other one

the clerk is being intentionally vague, as are the police.
the caution had to reach your address within 14 days, it didn't .

when you deal with the civil service, and the police etc you have to listen very carefully to what they are saying and how they say it.
often they are lying.

I would write to the police superintendent  and ask him specifically " what are yourvgrounds for saying you sent the
warning notice out on 6 /2 when in fact all the evidence points to it being sent out on 28/3 and received by me on  31/3 ? "

He will be reluctant to put it in  writing in his name if its dodgy - as he puts himself in a
traceable position if subsequently found to be a lie..
I would add to your letter  , " there is enough doubt on the legality of this notice for you to becable to use
your fair discretion in cancelling it "

It must be addressed to a Superintendent -- by name , is even better

You  don't have to do anything, you have proof of when you received the caution. It is up to them to disprove that if they can.

Are you the registered keeper? What do you mean by "caution" do you mean the Notice of intention to prosecute or the fixed penalty notice?

Looks like you've paid or been credited with paying the first offence.
Meaning the second offence was within the 14 days limit.

You are 4 times more likely to die if hit by a car doing 40mph rather than 30mph. Of course such statistics are of little concern to a driver encased in a ton of metal and protected by seat belts, airbags and other in-car safety devices.

starship by contacting the court you've admitted that you received the notice. Had you just ignored it and given how stretched the Old bill are do you think they would follow up a speeding ticket. A few years ago the Post office admitted to losing 47million items of mail in one year ! Tbh now your in the system I'd just pay it and take the points Sad

I had a child step out in front of me thankfully for him I was doing 28mph still sent him flying. Old bill didn't believe I'd hit him at that speed until they saw my front wing. I always keep to the limits in a built up area. The kid was OK more shocked than anything but not as shocked as me or his mum who witnessed it. She told the police she didn't know how I reacted so quickly to swerve my car to only catch him a glancing blow ! As it was around Christmas I was breathalysed, good job I hadn't had a drink the night before or I'd of gone from hero to zero Mischief

I no longer drive because of my eyesight but when I did I had no problems keeping within the limits in built up areas.
However on the motorways I constantly found myself way over the limit.

It's too easy go over the limit unintentionally if you have a lapse of concentration.

I went through a town that had a 40 mph limit then a 30 mph limit then 40 again and so on.
I found the episode was making demands on my concentration simply looking for the speed limit signs. On a long journey that is not very desirable.
Why not 30 all the way through?
Many 40 mph stretches in towns have queues if there are traffic lights along the way.
So what's the point of speeding up simply to get to the queue faster?

It's a limit, you don't have to go 40, if you have trouble reading the signs just stick at 30.

There's a problem with that Ken. The Highway Code tells us we should keep up with the flow of traffic. And for good reason.

I don't have any trouble reading the signs, it's the concentration it takes looking for them I have an issue with.
Then the chance you might miss one. And of course there will be a camera straight after it.

My Sat Nav, tomtom 6000 tells me about all cameras and warns me if I go over local speed limit, saved me £100s

I've got a device that tells me when I'm approaching a speed camera.
The trouble is it still warns me if the camera has been removed.

It doesn't tell you about hand held cameras though.

Last time I went on the motorway I was doing seventy and the detector started bleeping, so I slowed to 50 and got honked by others who I'd inconvenienced by slowing, and I never even saw the camera it was warning me about.

On Tomtom, when you pass a camera you are asked if it is still there, not many people reply but some do.
Tomtom then okay it (if they get enough updates) and add to system, probably less than 2 hours.

And that's one of the problems ufcdan. In 5th gear the car runs away with you and you can only keep your speed down by constant braking. On the speed awareness course you are taught to change down to probably 3rd when you see the 30 sign so the gears keep the speed down. If you take the advanced driving test it's an automatic fail for using 5th gear in a 30 zone. Similarly 2nd gear may be appropriate in a 20mph area.

Because the speed limit signs I'd already passed along that stretch were 50 mph.

This is the problem, you can never be sure whether you've missed one.

Why do you think so many people get caught, do you think they go through them too fast on purposeCrazy?

You shouldn't be driving Dr C. If you can't see a Fluorescent yellow box suspended 9 feet in the air and are not sure what speed you should be going because you think you've probably missed a speed limit sign then god knows what other signs you have missed.
