I doubt if he has any holidays but im uncertain. He only has a 16 hr contract but has been working 32 hrs for about 6 months and just been told in another month his overtime will be cut so he doesnt care anymore and said if he finds something else he ll leave there and then.

I said/did the very same thing on leaving my first 'proper' job for my second one.

I was working for the NHS and got a job in a casino one night after seeing it advertising for croupiers and the company started their training programme about 5 days later.

I handed in my notice the next day at the NHS - and would you believe, the 'boss' didn't want me to go and said he had me pencilled in for a promotion the very next month. I said "Thanks very much, but I don't want more money, I'm leaving on Friday"

He said: "You can't! You have to work a month's notice".

I said: "Well what are you going to do about it when I'm not here on Monday?"

He looked totally non-plussed, being the pen-pusher he was.
I left on the Friday, my salaried wage was paid in the bank until my departure date as usual - and I started a new job on the Monday.

I'd be surprised if he is on a month's notice for 16 hours a week. Might be worth a quick look at the paperwork, though I guess if he'd kept it, he wouldn't be asking you.

Just jack in and fook them, they will have to pursue you in court for what exactly? No money owed on either side. have never heard of anyone who has been chased by employers over notice period not served, its just courtesy

The only thing an employer can can do if you refuse to work your full notice period, other than hold back any accrued holiday pay,  is sack you and say so on your reference.

OP, the bottom line is when he chooses to not work out his notice there's really very little you can do (in practical terms) to stop him. Take it on the chin.

Employers would want reference from most recent employment. When getting references they check dates and etc looking for gaps.
Standard for people to miss out listing a job if they think they'll get a poor reference there but employers aware of that.

Where I worked most of us just took it on the chin, as TR suggests, if someone in our section did it but one or two were spiteful b4st4rds and would not accept it.

@Brendanuk Was a condition of employment with the company I worked for that we received two satisfactory references.
We didn't ask for them but merely wrote to or phoned previous employers.
