You might well find that the police are simply carrying out the rulings of the courts. You know, like doing their job.
I think it highly unlikely that the police do these things of their own volition. They are far more likely to be following preset procedures and systems set out by law...as is their job.

I believe the child was made a 'ward of court'. I don't defend plod or anybody else for that matter. I just try to get some people to try to form a rational opinion of their own, based upon what few facts they have to form a judgement.
It doesn't take too much rational thinking to decide that this is a far more complex affair than might first appear.

My opinions on 'Plod' with regard to these Pakistani grooming gangs and heir lack of response to rape charges would probably get me banned. I do not defend guilty parties.

I remember someone posted on chit - chat a few years back that once you go to the registry office to register the birth of your baby you have effectively given up the right to own your new born baby, the Government will let you look after it till its 18 but until then if you behave yourself  no-one will come calling to take your baby away from you but it certainly no longer belongs to you, I thought at the time that that is probably spot on & an episode such as this certainly hammers that school of thought home.
Report naydam September 2, 2014 10:26 PM BST
Wesdaq. I don't know any of the facts of what occurred. However, I'm fairly sure that the welfare of the child is the main concern of ALL departments involved...even when this may be contrary to the wishes of the parent(s).

The human rights of the sick child outrank those of the parent. I don't know how the kid was removed from the hospital, but I would guess it was against medical advice. So he was made a 'ward of court'. Kidnapped might be similar.

Now it's alright for everybody to clamour against the actions of the authorities...but ask yourself this: How were they supposed what this man planned to do next? How did they know what his plans were supposed to be?
And last, but by no means least: Did he really go to Spain to sell his house? Why take all the family? Why not just go on his own, sort out the sale and return? Wouldn't that be quickest and easiest?
Report guinness2dear September 2, 2014 10:35 PM BST
How did they know what his plans were supposed to be?

I would imagine that he told them if they wouldn't supply the treatment he would take him somewhere that would. There has been conflict reported between the parents and the hospital so it wasn't just a case of him disappearing without any reason.

The propery in Spain is i believe owned by the wife's mother. And would presumably have to have her consent?
Report Wesdag September 2, 2014 10:35 PM BST
naydam,

it is precisely due to this hysterical nonsense why plod behaved as they did.

It has been established that the child's life was never in danger and since when has it been a crime to take your family to Spain?

When you see Cameron & Clegg not siding with plod, that tells you everything you should need to know.

Still, there are those that will always side with plod regardless of the facts.

I think Brendan has it, the Soton General Hospital statement was poorly timed, defensive and quickly buried by the media.

As usual, the media miss the big picture and let Cameron and Clegg of scott free with the opportunity to act as cheerleader for the Kings:

Why -given the level of investment in the NHS and the amounts donated to cancer charities annually by the marvelously generous British public- is there a proton beam therapy centre in the Czech Republic already and yet we have to wait until 2018?

We're probably indirectly subsidising the CR centre via the EU.

Java. Please refrain from name-calling. It isn't necessary. I didn't post a 'view' of these events. I simply pointed out that the child's welfare is of paramount concern to ALL. This obviously, would include the parents' viewpoint, but theirs is not a professional opinion whereas, one would have to assume that the opinions of the doctors, child welfare, courts and whoever else was involved, ARE professional opinions.

I also get a sneaky feeling that the parents' story might be a little bit 'enhanced'. But THAT really is an opinion!

Report ReaseHeath September 2, 2014 11:53 PM BST
I can see where Naydam is coming from - just because the parents are only pursuing what they think are the best interests of their child, it does n't correspond that their judgement is beyond reproach (in fact, it may to some extent impair their judgement).

...but it misses the point, we surely know that the parents exclusively support the interests of their child, whereas that is unlikely to be the case of any of the other parties involved, irrespective of what they tell the media - the parents seemed well researched, they accept the potential side effects of the proton beam therapy but are looking to improve poor Ayesha's quality of life for the short time he is with them.

The cost of the treatment should be an irrelevance, even using a brutal economic assessment, the poor kid is n't going to be around long enough to incur the sort of state overhead most of us do during our long and cosseted lives, it really should n't matter who picks up the tab.

His parents think they're doing the right thing, that should be good enough - and it looks like they've got a result - pity they had to spend two or three days in jail, that Spanish judge deserves some flak for not bailing them in the first place as well...

His parents thinking that they are doing the right thing is NOT good enough. Would you say the same for parents who insist on removing their child from hospital because they want to take him to the witch-doctor? Or parents who refuse a blood transfusion for their child because of THEIR religious beliefs? Or the parents who want their female child to be mutilated because 'they know best'?

Parents do NOT exclusively support the needs of the child. They support THEIR interpretation of the needs of the child.
Report ReaseHeath September 3, 2014 12:41 AM BST
yes, of course,as I wrote in my first paragraph what they think are the best interests of the child.

Your points of comparison are invidious, hysterical and preposterous and not worthy of comment beyond that.

Do you have an opinion on the key issues around treatment options, parental input and treatment costs or are you solely concerned with unfounded speculation around the minutiae of the parents behaviour?

Report naydam September 3, 2014 1:23 AM BST
No, I don't have an opinion on what you see as the key issues. I don't know precisely what ails the kid. I have a small inkling regarding the treatment processes but not the costs. I also have no opinion on parental input as I am not privy to their thoughts or reasons for whatever they do.

I'm not too sure that my speculation is entirely unfounded. From what little I think I know on the matter the parents took a seriously ill child from the relatively safe environment of a hospital (possibly even a specialist hospital) and subjected him to a long journey to Spain. I don't know why it was necessary to take the child all that way, but they did.

Now, can anybody who has been paying attention to this case please tell me how the child ended up in hospital in Spain?

I don't know what invidious means. Blush

But they got locked up instead.

Report brendanuk1 September 3, 2014 6:07 AM BST
when the spanish police locked up the parents I imagine hospital was deemed best place for the child, otherwise he would have been left in care of siblings only.

Locking up his parents is the key. You have said parents not telling full truth, have hinted that he has come to some harm in his parents care during the journey. The authorities you like to suck off ie the CPS have dropped this like a stone because there is no evidence of criminality or reasonable expectation of a conviction. ie THEY DID NOTHING WRONG!!!!!
Report brendanuk1 September 3, 2014 6:53 AM BST
The CPS said that "there is insufficient evidence for a realistic prospect of conviction for any criminal offence".

Evidence showed the parents had taken steps to safeguard Ashya's health and two independent medical experts had indicated the risk to Ashya's life "was not as great as had been originally thought".

On the decision of the Southampton hospital to initially alert police, Hunt said: "I think it has been a very unfortunate sequence of events and there have clearly been misunderstandings along the way."

Parents are considering legal action against Southampton General Hospital, their lawyer said, claiming they were told by doctors there was no problem with them taking Ashya out of the UK for treatment.

Hampshire's police commissioner Simon Hayes said wanted assurance "as to the quality of the information given by Southampton General Hospital to Hampshire Constabulary".

Hospital made up the scare story because they didnt like being disagreed with, sadly its as simple as that.

If hospital was told before hand then, the kid would still be in the same hospital getting wrong treatment from parents view. They could not tell hospital as we now know how the hospital would have reacted. The parents did what was best for the child not the hospital. He will get better treatment from what they did
Report naydam September 3, 2014 9:15 AM BST
Right. So, let's go back to my original point that the police did NOT over-react. They were informed by the hospital that a seriously (I assume) ill young boy had been removed without notification or medical consent to an unknown location. In effect...kidnapped.
Apparently, they were told that he was in grave danger (my words) if he did not receive certain post-op medication within 24 hours from the time of his disappearance.

Now, given those circumstances and that information, what would YOU do? Please refrain from using information and details gleaned later in the saga. I await with bated breath.

"The authorities you like to suck off"...is there any real need to be insulting?

The child was recovering from major brain surgery. The parents then took him from the relative safety of a hospital. They then took him for a long journey without any medical safeguards. It was deemed that his well-being was endangered. A court order was issued making the child a ward of court. The police acted upon this order. The parents were arrested and the child returned to the safer environment of a hospital. It is not the fault of the police that the 'new' hospital is in Spain. That is the parents doing.

I have no idea what they intended to do with the sick child or where they intended to take him prior to the possible sale of a house. Or, indeed, where they intended to take him AFTER the sale of the house.

In my opinion the parents DID endanger the child's well-being. I also think that the police acted correctly, in accordance with their duty.

Assistant Chief Constable Chris Shead of Hampshire Police pretty much admitted that they had little real basis for the issue of a European Arrest Warrant when he said: 'I can confirm we have obtained a European Arrest Warrant. What that will do is, when we find Ashya and his family, it will allow us to talk to his parents about what happened. Clearly we need to find out what their motive is in taking Ashya.' Claiming that they were looking at an offence of neglect (presumably under Section 1 of the Children and Young Persons Act 1933), he admitted that ‘That does not necessarily mean they would be charged with that offence. It purely gives us the power to arrest and then we'll be able to speak to them.’

They wanted a chat basically, as authorities felt they weren't kept in the loop and family weren't picking up the phone to plod or hospital Cry which btw was an abuse of the EWA

The European Arrest Warrant can only be issued in the UK when the aim is a criminal prosecution, not just an investigation

It was a large enough gap that gave them time to get on a ferry.

Ashya King's family took him from Southampton general hospital on Thursday afternoon and travelled on a ferry to France some two hours later.

Hampshire Constabulary were told by the hospital that the youngster was missing at 8.35pm that day

Whatever time he went missing, I would assume, given his age and condition, that it was noticed immediately by hospital staff.

So I would further assume that they phoned the police at that time, plus a few minutes, as he was liable to die if his battery went flat.

The BBC reported they had taken the 4-00 p.m. ferry to Cherbourg, and gave the car registration plate number.

Brendans post implies that there was a MASSIVE gap between the child going missing and the hospital reporting it to the police.

UNLESS
The police are lying.
The BBC got the story wrong on the ferry time, as it was 6 and a half hours before he was reported missing to the police.

Taking all things into consideration, the whole operation was a shambles from start to finish.

CMAT. I started to type a long explanation and certain areas that might require further scrutiny by you and many others. But I thought 'Why bother'? You won't apply any logical thought to whatever I said, anyway.

So, let's just deal briefly with the time lapse. Child is taken in the afternoon. Police are informed at 8-35pm. They conduct search for family. They are probably now aware of further details such as a residence in Spain. They check ferry details. Bingo! The family car was booked on the 4-00pm ferry from x to y.

There is no requirement for any delay beyond that which it took to get from the hospital to the ferry.
There is a whole lot more that you should all be considering a bit more calmly...especially regarding the parents actions. But instead, I will simply be showered with insults. I would like you to think.

I didn't realise I was angry. Cool

FACT
They left on the ferry at 4-00 p.m.

CONJECTURE
This was said to be two hours after the child went missing.

SUBJECT TO A STEWARDS
Therefore he went missing at 2-00 p.m. and it took two hours to book the ferry, to drive there, and to get on it.

FACT
It was reported to Hampshire Constabulary at 8-35 p.m.

QUESTION
If the child was in mortal danger, as was suggested in the initial reports, as his battery was liable to go flat, why did it take the hospital 6 and a half hours to contact the police.

CONCLUSION
For whatever reason, there was a MASSIVE gap between A) and C), as I suggested earlier in my 22:37 post.

Are you deliberately being obtuse?

I wasn't suggesting that you were angry, just a little bit hasty perhaps.
If I can recall correctly, from the early reports that I overheard, the real danger wasn't necessarily immediate. It was more to do with with certain procedures, perhaps medication, that was time-sensitive and needed to be administered within the next 24 hours.

Now, I must admit that I misread (or misconstrued) your post regarding the timing of events and for that I apologise. The elapsed time was, as later stated, some six and a half hours. I can only guess that I wasn't paying enough attention to the post that I was replying to. Again, I apologise for that.

I don't know when the hospital first realised that the kid was missing but, apparently, the family were spending some time together. One needs to remember, though, that this is a hospital and not a prison and it would take quite a while to realise that the kid had actually been removed.
The police seem to have responded promptly and professionally to the information they were given. Of course, time may prove otherwise.

Thanks, it's a shame that all those who are proven wrong can't post a civil apology instead of abuse.

CMAT. Just to clarify matters. My apologies were for not reading your post properly and totally misunderstanding what you said. I should have read it again before responding. For that I apologise.

As for being right or wrong on the actions taken by the parents, the hospital or the police...that would be a different ball game. However, I think this case has been done to death and I shall attempt to withdraw from the subject. Maybe it will resurface at a future date.

Thank you for your gracious response.
