I know what the loophole is.
It's "Let 50 hardened nutters smoke in your pub, because other they'll terrorise the streets, so the police turn a blind eye to it just to make their lives and everybody else's easier".

Smoking is permitted in the theatre by actors if it is a part of the story. So a stand-up comedian, telling a smoking gag in a pub for instance, would likewise be permitted to smoke. However, the pub would need a live performance licence.
Have not caught a bus in ages now,i bet people are still smoking on the double deckers at the back.
