X Factor contestant Gamu Nhengu has been refused the right to remain in the UK following a Home Office investigation, it has been reported.

The singer has apparently been told to return to her home country of Zimbabwe within days after immigration officials discovered that her mother had claimed £16,000 in benefits to which she was not entitled.

Nokutula Ngazana, 38, is said to have claimed child tax credit and working tax credit during her eight-year stay in the UK, even though her visa conditions prohibited her from having access to state handouts.

Nhengu - who was applying to remain in the UK after her family's right to stay expired in August - must now leave Britain of her own accord, along with her mother and her two brothers, or face deportation, according to The Sun.

A UK Border Agency spokeswoman confirmed: "The applications made by Ms Ngazana and her family were considered in line with the published immigration rules.

"Ms Ngazana's application was refused as it did not meet all of the conditions for approval. Skilled workers are not allowed recourse to public funds.

"Her family, who had applied as her dependants, were therefore also refused. Where people are found to have no right to remain in the UK we expect them to leave voluntarily."

Ngazana and Nhengu arrived in Scotland in 2002 and set up home in Tillicoultry, Clackmannanshire, where they still live today. Ngazana studied at Stirling University and qualified as a nurse.

Immigration Minister Damian Green was reportedly consulted on the issue before an official letter was sent to the family.

The news follows speculation that the controversial decision not to pick Nhengu for The X Factor's Top 12 was due to concerns surrounding her visa renewal.

Would it not be apt, and in true Cowell style, for him to step in now, pulls some strings, and get Gamu re-instated? What with all his philanthropic endeavours, like his song for the troops, this is the perfect window for him to don his cape once more. He usually does not miss any positive PR opportunity.

Well done cheps I think it was the right decision to take her out of the betting given the events of today. Theres only 1 book still quoting her blew sq which is poor form on their part paddies are forgiven as they are with a run. Was hoping that laddies got massive negative publicity on it and decided to refund stakes so I could get my £50 stake backCry

In Saturday's show Cowell will stand up to make a special anouncement. He will declare that he has managed to rescue Gamu from the Zimbabwe warlords and will be in the contest from next week. Gamu suddenly appears and runs to daddy Cowell. She cries, he cries, and the whole audience cries with happiness. Cowell is declared a hero and is made a saint.

I think I would be violently sick if that happened, and I've just bought a new carpet. He'd have to offer her a job, he couldn't just tell immigration she's in a competition. Can't see it happening but I'll carry a sick bag just in case.

Shame that a trainee nurse is chucked out for claiming benefits to provide for her kids whilst she makes a valuable input into the countrys health system whilst most claimants, those that I know, are spending it down the pub and not looking for any work.

She only sought to bring happiness to people; to sing for them and make they feel good if only for a few moments. And for a while she did. I think it would be a positive benefit to this country for Gamu to stay here.

Whatever. You to not need to live in the UK to start a music career I actually believe Gamu is on her way to major international success.

She may in the end be better off for being away from the Cowell pantomime.

All this hoo haa is prefectly timed to coincide with the shock surprise twist weekend. I will not rule out the above Happening. Its maximum publicity for Syco and everyones a winner. Simon, Gamu, the Press, the chatering classes and me of course.

What I really think is that Gamu and xfactor is finish. I'd just like Gamu to now get a decent manager and backer. Not Machachevelli Cowell, not Mugabe, not warlord, not a corrupt politician, not some show biz  shark not the Jacksons. But does this exist in show biz.

Immigration appeal over X-factor Gamu's visa

The lawyer for the family of X Factor entrant Gamu Nhengu has confirmed she will appeal against a Home Office decision to send them back to Zimbabwe.

Frances Farrell said she had intended to seek a judicial review, but now believes there are grounds to appeal directly to the immigration tribunal.

Gamu's mother, Nokuthula Ngazana, was refused permission to stay in the UK after her visa expired in August.

Mrs Ngazana has been living in Clackmannanshire for eight years.

Her daughter was controversially eliminated from ITV's X Factor on Sunday. The show's bossed have denied reports that the decision was influenced by fears that Gamu's visa was about to run out.

Almost 250,000 people have joined a Facebook campaign calling for Gamu's return to the show.

Family lawyer Mrs Farrell said the situation had been "very upsetting for all the family" and deplored the leaking of confidential details of the case to some newspapers.

"We believe there is a right of appeal against the decision and we're going to be lodging an appeal with the immigration tribunal as soon as possible," she said.

"My client has been in this country for about eight years now, absolutely legally all the time."

She also said she would refute claims that the family had claimed benefits illegally, contending that Gamu's mother Nokutula Ngazana had been advised by the Inland Revenue that she could claim Working Tax Credit and Child Tax Credit.


About 150 people gathered outside Gamu's house to show their support
The visa extension was turned down on the grounds there was an administrative error in the application.

The family's solicitors said the error was due to Mrs Ngazana giving the wrong bank details, so the fee for the application could not be taken.

The application was judged "out of time" as a result, but the lawyers said it was lodged in time.

A crowd of about 150 people gathered outside the family's home in Tillicoultry to show their support after news of the visa refusal was made public.

Many of them where pupils at Alva Academy, where Gamu used to be a pupil.

And locals have now started an online petition against the decision by the UK Border Agency.

More than 1,100 people have signed the appeal started by John Locke, the pastor of the evangelical church that Gamu and her family attend.

These people know the rules when they apply for the visa (terms of her stay clearly spelt out to her). She ignored those rules and therefore should be treated as a benefits cheat. Just because her daughter appeared on X Factor should be no factor. This country needs to stop being so soft!

X FACTOR reject Gamu Nhengu won a new ally in her deportation battle last night - the show's multi-millionaire boss Simon Cowell.


Cowell has ordered his lawyers to take on Home Office bureaucrats who plan to deport the 18-year-old singer from the UK.

He told The Sun: "We are helping Gamu and her family as much as possible and have lawyers working with her lawyers.

"It's not because we have to but because I really feel for their situation, and that's outside of the show."

The timing is perfect the benfits to Simon, Syco and xfactor are massive. Whats stopping him?

Hoo haa plus boo hiss plus outrage thats the only music Simon understands. And very profitable it is too.


On the otherhand I would gain so much from this that I have financially and emotionally written Gamu out of xfactor. What is annoying me is that another story line on this says that Simon does not want Gamu to sign any record deals and to save herself for next year. So he has avoided the threat to his Xmas single. If he did the right thing (ie let her do waht she wants now she is off his show),  then this would walk the Xmas number one.

I said before I think it's such a shame she isn't in it.  I'm only really laying a few at the moment in the hope they don't win obviously and that someone like Gamu up against them would make it harder still.  If she were in it she'd really be in with as good a shout as any I think.

But even peole who think it an anxiomatic truth some-one who mistakenly claims tax rielif should be banished to a muderous regime surely also must think its axiomatic that some-ne who can pay loads of taxes, create jobs and give tons of pleasure should also be allowed to stay. Especailly if they have a mother who is good at helping the sick, old and dying. In which case you are in a contradiction.

On the other hand I just want Gamu to stay because I follow my heart and there are no contradictions in the Melvian heart.
