Also like the pikeys who all got 3k each in England over being refused from Wetherspoons, there are lads getting refused from pubs / clubs (by meatheads who are not intelligent enough to get any other job bar doorman) every weekend in every city / town of the country and none of them would get compensation over it, guess it does back up what Timberman has been saying for years. The judge declared that the bakery had discriminated against the customer on the basis of his sexuality.
But that seems faulty to me. The baker did not necessarily know the sexual orientation of the customer -it could have been anyone ordering that cake ...a straight Christian who supported gay rights...an atheist doing it for a spoof etc. Incidentally -in this case the argument from sincere conscientious belief has been overridden. Yet here in the Republic e.g.medical professionals have the right to absent themselves from processes that might result in an abortion -on conscientious grounds (where these clearly derive from religious conviction.) I hope the bakery mounts an appeal and are financially supported to do so. |

A quick skim of the case suggests many have missed the nuances.
A contract was entered into,. Offer and Acceptance. When the bakery heard what was to be written on the cake they decided to break the contract and gave a very honest reason for doing so. The reason was subjective and quite clearly discriminatory. A contract cannot be broken for such reasons, otherwise contract law itself would be undermined. Had they obtusely said they had over-booked and had to cancel..or that they had run out of ingredients or an oven had broken .....whatever....they wouldn't have been accused of discriminatory behaviour...and given that the contract merely related to baking a cake.....its hard to see anyone accusing anyone of breach of contract We live in a much maligned age of political correctness. Like it or not, we have to play by the rules, and it can be simpler to obfuscate rather than be direct and truthful. After all, we are not going to turn around and say..Sorry we don't bake cakes for, N1ggers or Quaaaars....even if its the truth.....that sort of directness has been eradicated from polite society, now a further layer of obfuscation is required. Play by these rules, and you won't have to bake cakes for anyone you don't want to. |

The reason the cake was refused was nothing to do with the individual that ordered the cake,it was to do with the political slogan.
