Burke has the right to appeal within the next seven days. Burke trains 90 horses from Spigot Lodge in North Yorks. Only recently, he sent out Lord Shanakill to win the Group One Prix Jean Prat at Chantilly and he has sent out 34 British winners this year. The Disciplinary Panel heard that Burke could legitimately have made contact with Rodgers on matters unrelated to racing, but their conclusion was that "the sheer volume of traffic [208 phone calls in 20 weeks] and the concentration of this around the time of the suspect races provided clear evidence of the breaches belatedly admitted by Burke." The report continued: "The panel was particularly struck by the fact that Burke went to the trouble of getting a new mobile phone number, which he began to use in early June 2004 to conduct his exchanges with Rodgers. "This was not disclosed to the Jockey Club. Its purpose was to try to conceal the contacts from any later investigation, an attempt which Burke continued to make right up until the day of the Inquiry. Burke declined to make a comment after the hearing until he had spoken to his legal advisers.
