I am in a bit of a quandary, I have been renting a flat on
behalf of my daughters who are students in London, the
landlord has proved a right git not doing repairs and things
like that. The tenancy ends in june and there is one more
months rent due to him which I do not want to pay and would
much prefer the landlord to keep the deposit he is holding
in lieu of me paying the final months rent as I feel would
have a struggle to get the deposit back. My question is
this what could he do in the short term which would affect
my girls.

He could evict them for not paying the rent and most likely saddle you with his court costs.
It's a very litigious town (county court slap in the middle). Pay him his months rent and tackle the deposit problem if it arises. |

hippie, would he have the time to evict them? The last months rent is due on the
28th of May and the girls will be leaving his place on the 2nd weekend of june. |

if not already done so, get your requests for repairs etc in writing / email or documented somehow
Photos (with dates attached or imprinted on the images, data files) of all damage, wear and tear and lack of maintenance will come in useful later if ever have to resort to legal recompense |

Probably not but you would most likely lose your deposit and leave yourself open for a court case.
It's a nasty little town where the freemason handshake goes a long way. my advice is bite the bullet. |

pedrobob, the guy is an Iranian a real Rsole and I just feel that I would have
to spit blood to get anything back from him. I have copies of emails and the like to which he has not replied, it took him 6 months to change a broken shower head. |

mange, he originally had a firm in the West End of London acting for him but they
eventually left him to manage it himself. I was on the 1st of june going to ring the git and tell him that because he had been such a woeful landlord he should keep the deposit and my girls who by that time have finished their finals were leaving asap and he could have his place back early, I was thinking that would placate the twot. |

You are obliged to pay the rent as it falls due, the deposit is not in lieu of rent and failing to pay the final one could still see you in court or slapped with a CCJ ... is it worth that hassle for you / daughters. You have a rent book and receipt for your deposit I take it? Then you won't have an issue. If he refuses to return said deposit without good cause then YOU take him to court (small claims court, simple) Suggest they take pictures with date/time clearly indicated on them to show that it's in good condition when they leave in case he tries to mess the place up.

Bear in mind who's name is on the rent book because that would be the name who's credit rating would be jeopardised.

Personally I have failed to pay the last months rent once when I thought I wasn't going to get a deposit back and nothing happened. I also know other people who have done the same. You will likely get away with it with no problem. Even if legal action is taken I would expect it to take longer than a month. Be aware there is risk involved, but it is also quite a common thing to do.

is it likely the landlord would bother coming after you for a months rent and incurring the related legal costs?
If you wrote to him and told him what you were doing before June, listing all the repairs that have not been done, all the failed maintenance of the property, surely the costs of all that will far exceed a months rent? Would not a small claims court not just take your documented "counter-claim" into account and tell the landlord to b*gger off? |

Any landlord taking a deposit under a short-term agreement must hold it under a TDP - look up the www.gov.uk page on this. Your daughters, or whoever guarantees the rent, would have been advised who holds this. If he hasn't you have the right to approach the County Court. |

It would take him up to 6 months to evict, in which time they can stay there rent free, nothing he could do about it.
