Martin Keighley & Milton Harris
The Disciplinary Panel of the British Horseracing Authority (BHA) held an enquiry on 19th July 2012 to consider whether or not Martin Keighley, a licensed trainer, had committed a breach of Schedule (B)3 paragraph 23 of the Rules of Racing, in that CHANINBAR (FR) ran in the Shloer Chase at Cheltenham on 13th November 2011 when the gelding had not been in training with Keighley for the 14 days immediately prior to the race. Also, whether Mr Milton Harris, the racing manager to the owners of CHANINBAR (FR), had committed a breach of Rule (A)37 by assisting and encouraging Keighley to act in contravention of Schedule (B)3 paragraph 23.2.
Keighley admitted that he was in breach of Schedule (B)3 paragraph 23, and the Panel heard evidence from him. Mr Harris admitted a breach of Rule (A)37, and the Panel heard evidence from him and submissions from his legal representative.
The Panel noted that CHANINBAR (FR) went into training with Keighley on 6th November 2011 and that prior to this date the gelding was in pre-training with Mr Harris. On 7th November the Shloer Chase at Cheltenham on 13th November was re-opened because of a lack of entries and, following discussions with Mr Harris, the owners decided to enter CHANINBAR (FR) into the race. As neither Keighley nor Mr Harris had Authority to Act for the owners both the entry and subsequent declaration to run were made by the owners themselves.
The owners had no dealings with Keighley in respect of whether or not to enter CHANINBAR (FR) in the Shloer Chase. All such discussions were with Mr Harris. Without the assistance/involvement of Mr Harris it is highly unlikely that CHANINBAR (FR) would have been entered in the race.
Having heard the evidence the Panel accepted the admissions from Keighley and Mr Harris that they were in breach of the respective Rules. Taking into account that both Keighley and Mr Harris were fully aware of the 14 day requirement, but still chose to enter and run CHANINBAR (FR) the Panel imposed a fine of £5,000 upon Keighley and £5,000 upon Mr Harris.

The Stewards held an enquiry following a report from the Clerk of the Scales that the representative of Kevin Ryan, the trainer of DAFFYD, had added equipment after weighing out. They interviewed the rider, the trainer’s representative and the Clerk of the Scales. Having heard their evidence the Stewards found the trainer in breach of Rule (C)43.5.3 and fined him £140
