Jockeys have not needed to raise the issues before. They are primarily taking note of where other horses are, not where a marker is. If you are on the rails you can see the marker. If you are overtaking horses that obscure the furlong pole to the rider's view then you cannot see exactly where the marker is.
As no furlong marker in UK racing is 1 furlong from the finish line there is an easy "legal" loophole to exploit. BHA could rule that a white marker line is painted across the course at 220 yards from the finish line. If they did that for all marker positions, folks could do their own sectionals at practically no cost to the courses.
