You could once give a horse a light tap of encouragement. If he/she didn't respond then more encouragement was needed.

BHA rules will lead to less of the light taps and more of making it count with your limited resources.

Fallon and his clones Turner, Catlin and Milkshake have been getting away with it for years, using whip way above shoulder.
Why do you think Turner and Milkshake are consistently able to mix it with the big boys?, its not because they're stronger its simply the forceful use of their whip which has disguised their natural weakness.
