49. Jump races: directing riders around an obstacle (by-pass procedures)
49.1 Where


49.1.1 direction markers have been inserted in an Obstacle to indicate that it is unsafe to jump, or
49.1.2 direction markers have been inserted in such an Obstacle and at the entrance to an extended lead-in to the Obstacle, and cones have also been deployed at the lead-in,

a Rider must proceed around the Obstacle as indicated by the direction markers and continue in the race, following the correctly marked course.
49.2 If a Rider is unable to follow the direction markers, he must pull up.
49.3 The Stewards may decide not to take Disciplinary Action against a Rider for a contravention of Paragraphs 49.1 or 49.2 if the Rider satisfies them that he had reasonable cause.
49.4 The horse of a Rider who is found to have contravened Paragraphs 49.1 or 49.2 shall, on an objection to the Stewards under Part 7, be disqualified unless the Stewards consider that extraordinary circumstances justified the Rider in acting as he did, in that



49.4.1 all Riders remaining in the race took the same course, and
49.4.2 no Rider obtained an unfair advantage as a result.

Have great sympathy for the riders. A split second decision needed to be mad after rounding the bend. The rider awarded the race changed his mind if you watch the replay.

i think the placement of the flag wavers needs to be looked at.....the 2 on the rails only served to confuse the issue.....flag wavers in future notifying of a hazard probably need to be somewhere in the vicinity of the hazard i would have thought.

What are the rules regarding pulling up? Are jocks allowed to pull up for no reason? Schofiled's mount seemed to be OK and was still in with a chance of getting placed. He took the wrong course then pulled up. I have sympathy for Cooke but Schofield should be done.

It is a third similar incident for Cook. He received a 28-day ban for taking the wrong course on Our Vic in the Boylesports Gold Cup and also took the wrong course at Huntingdon last March.

CONDITIONAL jockey Danny Cook faces a substantial ban after taking the wrong course on Gaspara in the Mint Casino, Torquay Handicap Hurdle at Newton Abbot on Friday.

The incident was the third time in just over 12 months that Cook, who is based with David Pipe, has broken the rules for taking the wrong course and it follows on from a similar offence aboard Our Vic at Cheltenham in December for which received a 28-day ban.

Cook was also handed a 12-day suspension for taking the wrong course on the Pipe-trained Come On Jonny at Huntingdon a year ago last March, when he was one of five riders to have gone the wrong way.

On this occasion, the well-backed Gaspara was taken around the second last hurdle by Cook as racecourse veterinary staff attended the stricken Future Vision, who had broken down badly on the previous circuit.

The mare finished first past the post from Tabaran, who had jumped the second-last hurdle, but atthe stewards' enquiry, Gaspara was disqualified and placed last with the race being handed to Tabaran, ridden by 7lb conditional Oliver Dayman.

On dismounting, Cook was heckled by a racegoer who shouted: "How many more** ups, Danny? You did the same on Our Vic at Cheltenham last December."

A clearly shaken Cook said: "There was a flagman waving a big flag at the point of the incident and shouting at us to go round the hurdle. I could have jumped it if he had not been there."

Tabaran's rider Dayman added: "I could see the flagman and there were people shouting but the hurdle was not dolled off. I made a split-second decision to jump the hurdle as a result and I supposeI have been proved right."

Bookmakers dont payout on horses who a) Take the wrong course or b)Weight in light.
Otherwise you may have an unscruplous jockey somewhere in a 2 mile chase only carrying 7stone and not jumping a fence

And you could have an unscrupulous coruse official who influences a rider to take the wrong course. Who would benefit from that, especially a favourite that had been well backed all day and doubled up with another runner from the same stable? A thorough investigation is needed.

don't understand the the sympathy for this jockey. If you're not competent enough to steer your horse around the correct course, then you shouldn't be riding. simple as that.

One thing is for sure,that he certainly should not be banned or fined when he attends his hearing in London.Its the flagmen who were seriously at fault.The stewards must take the view that the flagmen DIDN'T do their job properly and were ill advised as what to do by the racecourse officials.The outcome will be interesting.

I know its only a hurdle but he doesn't know what is on the other side of the jump (like the Chepstow race recently). He did the right thing

The rules have got zero flexibility so he had to be DQed

Be totally wrong to ban Cook for it

There was no point in the flagmen waving flags, the natural line would not have taken the horses near to where the screens were.

The position of the flagmen was a joke and they caused the confusion.

Flagmen at NA now position themselves behind the barrier cos they have nearly been mown down in the past when standing in the middle of the track. However, tonight in the middle of the track is where he should have been.

Soap How many times is he allowed to make the same mistake? Suppose some undesirable punter got hold of a jouneyman jockey and told him if he was riding a short price one to run out if hes in front going to the last, cos D.Cook has ran out 3 times now and got no more then a slap on the wrist. . .Where do the BHA draw the line...3 times hes done it hes cost punters 100s of thousands.

I think regardless of 1sr or 2nd or 3rd time this was diff circumstances, and obviously is not as clear as you make out else why did people not snap up the lay at 2.3 available for 10 mins after race

you have to put this race in perspective, he had seconds to make a decision and unfortunately for him and the masses who backed the horse it was the wrong one. the flag waver before the flight, hanging over the rails didnt help but you have to remember it was caused by a horrible injury to the horse at that flight on the previous circuit. safety has to came first, for those who were involved in attending to the striken horse. in saying that you would think in this day an age there would be a better system in place to cover such an incident and i'm sure the course will take a hard look in the part it played today.
no doubt danny cook is suffering at the moment as are the punters who backed gaspara. he is a promising young jockey, his past record is not good but he was unfortunate today, that i have no doubt. i can fully understand and i hate using the word pocket talkers and how they are feeling but banning him for months is not the answer imo.
hopefully this will never happen again, unfortunatelyfrom what is supposed to be the best racing in the world, i very much doubt this will be true. good luck tomorrow if you lost out today, hopefully a winning day on saturday.

I have massive sympathy for Danny Cook here. Some bloke waving a flag shouting at you in the heat of battle - why wouldn;t he automatically think "** - I can;t jump this!" -

How does he know what's on the other side of the hurdle?

How does he know they have not had time to put out cones?

Was the flag they were waving a different colour to one that means go round the next obstacle?

He will get banned - but only because the BHA will refuse to admit that their system has a flaw. It clearly does. How many people knew exactly what was going on as they were watching that race?

Ive seen hundreds of races for my sins - never seen a flag waved before a hurdle/fence that you were still allowed to jump!

I should rephrase that, that makes it sound as if he was up to skull-duggery.

The jockeys on the second, third and fourth were just behind him and if they heard any shouting why didnt they jump to his defence and say "we heard shouting also but it was too late to do anything about it"!

This was his take on it for 20 minutes on the site after the event:

Errr...That was it.

Very insightful - The Racing Post reporter had no idea what was going on. As did very few people for a long time after the race.

Putting the boot in with his written report 2 hours later when it suits him!

Soap, I wasn't trying to be a tool, I just thought that Tabaran might have won if Gaspara had jumped the hurdle, that's all. You can't always believe what the RP tells you.

anyone think that the other jock who missed the last (nick schofield ?) has done a bit of quick thinking and went for the pulling up option ,no way was he pulling up imo and if there was two of them who made the mistake they would both have a better chance at appeal but he has quickly seen how foolish he was to follow gaspara ,only by chance i was taking a break from punting or that would have emptied me today ,feel real sorry for the backers though and perhaps there was mitigating circumstances for letting the result stand ,6 months seems severe for a split second bad decision made by one fearfull he might be about to make worse an injury/medical situation in front of him ,poor show all round and the only winners are the bookies .void race would have been a very fair result .

My explanation is that racing for change have introduced linesmen into racing and he was actually flagging one of the runners offside.

I don't see how that horse at Chepstow a few months back can keep the race and Gaspara gets disqualified for what are very similar circumstances.
The flagman messed up the jockey, pure and simple. Just because there were no barriers in front of the hurdle doesn't mean that it had to be jumped. There wouldn't always be time to put up barriers, say a horse looked like he was getting out of the way from the previous circuit but then collapsed. In a split-second decision you really have to obey the flag-waving and not the fact that the hurdle was not dolled off.

The stewards have made a decision that the flagman was in the wrong and that young Cook should have known this and ignored him (I'm not quite sure how) and that the flagman was in the right in the Chepstow case. In both cases the jockey followed the example of the flagman. No consistency here.

Yes, it is my pocket talking, I had laid back my stake here on the exhanges, so didn't lose on the race. But I still think Gaspara was hard done by. I think she had the runner-up well covered and lost a lot of momentum pulling around the flight and jumped the last poorly because of it.

The jockey on the runner-up has said he heard shouting too.
No consistency on the rules overall.
People looking for a 6 month ban for young Cook are talking rubbish.

A farce really.

Firstly, Gaspara wins easily if she jumps the 2nd last. Cook slowed her right down and lost a good few lengths and momentum. Even with the mistake at the last she's always holding the runner-up. Race was put to bed before the incident.

Secondly, the flag-waver is pointing out to the side that Cook went around. How much time do you really have to assess the situation? I think I would have done the same as Cook. The flag certainly wasn't indicating to pass the flight on the other side. It was pointing out to the side, and was still pointing when the first 2 were crossing the line. The fact that it wasn't dolled-off is not really relevant.

A farce.

The trouble is - the guys employed to wave flags -- get to do the job once every leap year- They get paid peanuts- for standing in front of a pack of horses running @ 30 mile per hour. The guy in front of the hurdle was waving a flag as if his life was in danger- the other guy was stood by the stricken horse pointing for Cook to jump the obstacle.
The whole episode was a** up - Danny Cook made a mistake because he was confused -- The lad made a mistake- OK. He's a very promising lad. He should get the benefit of the doubt and get his knuckles smacked. The Guy with the first Flag should NOT apply for a job as an air traffic controller !!!!!!

Not sur if anyone's commented on this, but if you watch the replay, there's another reason to omit the hurdle.

One of the hurdles is clearly not in place and, normally, it should have been omitted under present procedures. Presumably it wasn't as the flagman were dealing with the other incident.

Genuine mistakes shouldn't be punished with such severity of blantant breaking of rules such as easing up and excessive use of the whip. How would you like to be banned for work for six months (unpaid) if you made a genuine mistake

he went the wrong way .blame the jockey , not the course . the bloke had a warning flag in his hand meaning that there was a hazard ahead .

no markers were in the hurdle and danny then rides towards the stricken horse . he had a brain storm imo and only has his self to blame
