Gai Waterhouse has launched Supreme Court action in a bid to ensure stable jockey Nash Rawiller rides Theseo in Saturday's $1.5 million Doncaster Mile at Randwick.

The champion trainer, who has won the famous metric mile six times, took the unprecedented step of launching legal action yesterday.

On Monday Racing NSW ruled that Waterhouse's stable jockey Nash Rawiller had been booked for the ride on the Chris Waller-trained Rangirangdo in the Doncaster.

Waterhouse immediately fired off a letter to Racing NSW appealing against the decision. This morning the ruling body's independent Appeal Panel principle member John Hiatt confirmed it did not have the power to hear the matter under section 42 of the Thoroughbred Racing Act.

"He [Rawiller] was booked from day one," Waterhouse said at Canterbury today while adding "see you in the Supreme Court at 2.00 tomorrow afternoon."

Waterhouse confirmed class jockey Darren Beadman, who is now based in Hong Kong, has been placed on standby to ride Theseo.
