i'm sure if financial transactions show exact details of where the money came from and there are no tax implications accompanied with maybe some documentation from the 2 friends then you would think all should be ok.

I think you're limited to 4k (or so) in cash to take through customs. She will need 100% evidence as to where the money came from - bank statements I think

She says she's got this. No idea about the tax situation of the payees though, will they investigate this far? I hoped once she proved the money wasn't from her husband that would be an end to it.

Surely she must have realised that she would encounter a problem?
|

I know what you mean, Jimmy. Seems odd she didn't check out the situation beforehand. She's only 21 though and I assume just didn't think. Not sure I would have been so canny at that age.

She can easily get money back. Most likely she received some proof of seizure and there on it, you can find notes about what you can do now. Just follow.

This does sound rather odd, coming from Cat. Is this a test Cat?

oh come off it! 7k just being "carried" through customs... I expect you believe in Father Christmas as well... Errr, how far does 7K go in a year? |
|
By:
If you don't believe in credit cards (like me?)
|

I have seen the documentation from customs so, yes, she was carrying the cash. It's not quite as straight forward as reading the forms because it doesn't say what she needs to do exactly just that she can appeal the decision but this would involve solicitors and cash which she doesn't have.
She has a uk passport so is entitled to work in the uk. Not a test, cooee, I appreciate the opinions/advice given on here. |

Since the POCA came in the onus has moved very much onto individuals proving that their assets have come from legitimate sources rather than the authorities having to prove they haven't. It is almost a guilty until proven innocent situation which I suppose when you think about it is actually quite fair as it is easy for most people to prove income etc.
It is designed to give authorities an easier route to getting drug dealer assets etc without having to convict them of anything. In this case if she can prove the source she should be fine. Explaining that some had come from her drug associated ex husband was probably not the wisest move! |

high time we legalised drugs and were done with this twaddle.

Thanks everyone. I think I'll just call them in the morning and see what they say.

Friend of mine had same problem. He found a lawyer and it took him two years to get back the money.

Spoke to a solicitor who reckons she should get it back once the true facts are disclosed.

HM Customs website says you only have to declare if its over 10k in euros (8.7k GBP) ?

They can still seize it if they have grounds to believe it has been acquired illegally.
