Here is some news that shows the sale of the tote may be challenged legally

Office of Fair Trading investigating Tote sale to BetFred
The UK’s Office of Fair Trading (OFT) is investigating whether the sale of the state-owned Tote to Betfred would result in a "substantial lessening of competition".

The OFT could then refer the deal to the Competition Commission, placing the £265m sale in doubt or ask BetFred to sell part of the betting shop estate to smaller bookmakers.

The news came just as Fred Done cancelled the Tote’s sponsorship of the members of the Racehorse Owners Association’s colours. The bookmaker which had promised to work with racing recently stated: "we need fun this business - it is not just about winning and losing." Apparently making money is important as well.
