A website for a company selling information about a betting system stated "Here's How to Turn the ONLY Unfair Advantage Left in Betting Into Profits Of £109,148.69 Or More Every Month". It also featured a screen shot of the apparent author’s bank account showing a cleared balance of £82,648. Text also stated “And I’m not the Only One With These Incredible Results From Betting Scalper - Check Out Just a Few Screenshots I’ve Recieved (sic) From Friends I’ve Shared This With!” Below this text were images, apparently from three separate online betting accounts, showing monthly winnings on horse racing over £19,000. The website also stated "The solution came out of sheer desperation (I had to find something that worked ... FAST... or I’d have to find a “real job”)... my discovery of a little “lost” betting strategy called arbitrage".

Issue
1. The complainant challenged whether the claim "Here's How to Turn the ONLY Unfair Advantage Left in Betting Into Profits Of £109,148.69 Or More Every Month", could be substantiated.

The ASA challenged whether:

2. the examples of people who had made profits using the product could be substantiated;

3. the claims that one would achieve a winning from every bet using the product could be substantiated; and

4. the website was socially irresponsible for representing gambling as an alternative to employment.

Response
1. Betting Scalper stated that any amount of profit could be made because they used an arbitrage system. They said if a consumer made higher bets their profits would be higher.

2. Betting Scalper said they received daily testimonials from people who had made profits with the system.

3. They said that because the product used an arbitrage system, only successful bets would be placed.

4. Betting Scalper said they would amend the website to make it clear that they were not suggesting gambling as an alternative to employment.


Assessment
1. Upheld

The ASA noted that the website stated "Here's How to Turn the ONLY Unfair Advantage Left in Betting Into Profits Of £109,148.69 Or More Every Month". We considered that this was an objective claim, capable of substantiation with documentary evidence. We noted that Betting Scalper asserted that any amount of profits could be made using the product. However, because we had not seen any evidence in support of the claim, we concluded that it was unsubstantiated and therefore misleading.

2. Upheld

We noted Betting Scalpers assertion that they received testimonials, on a daily basis, from people who had made profits using their system. We also noted that the website featured what appeared to be screen shots of online betting account statements showing substantial monthly winnings. Because Betting Scalper had not provided any evidence in support of the claims that the profits shown in these images were made using the product, we concluded that the claims were unsubstantiated and therefore misleading.

3. Upheld

We noted that Betting Scalper said the product utilised an arbitrage system and therefore that only successful bets could be placed. However, we considered that the claims that one would achieve a win from every bet were objective claims capable of substantiation with suitable evidence. Because Betting Scalper had not provided any evidence in support of these claims, we concluded that they were unsubstantiated and therefore misleading.

4. Upheld

We welcomed Betting Scalper's willingness to change the website to remove any implication that gambling represented an alternative to employment. However, we noted that the website stated "The solution came out of sheer desperation (I had to find something that worked ... FAST ... or I'd have find a 'real job')". We considered that this implied that gambling was a viable alternative to employment. Because of this we concluded that the website was socially irresponsible and breached the Code.

The website breached CAP Code (Edition 12) rules 3.1 (Misleading advertising), 3.7 (Substantiation), 3.11 (Exaggeration), 3.14 (Prohibited claims), 16.1 and 16.3.4 (Gambling).


Action
The website should not appear again in its current form. We told Betting Scalper to remove the claims found to be in breach of the Code from their marketing.

If you were making a million a year from gambling why would you bother writing books?

If you gave away the magic formula in a publication surely it would lead to the inevitable reduction in your profits?

no moves, you put it straight in its nutshell, amazing systems would never be sold to the masses as the possible sale of such information would

1.... the amazing system would never ever reach the profit possible in information sales by actually just using the said claimed profitable system!

2....any brilliant amazing system released to the masses would have a detrimental effect to the market

3....even the best information services available proofed never reach anything near a super system status in proofed points profit to validate point 1 and 2 listed before.

4.....and old saying full of wisdom states " IF SOMETHING SEEMS TOO GOOD TOO BE TRUE, THEN IT MOST USUALLY IS"

some people in life look for that amazing brilliant invention from the best minds to fill the pockets evermore with wealth, but if you can get every fool to give you one pound each for any silly notion you care to pedal then you will become a much richer person!
