Smart move going on the sick with something like stress. He could be out for months with it and if it is found that his employers contributed to his illness in anyway then he'll be liable for compo.

Never read a contract but I am very familiar with Health and Safety and if his employers' unreasonable behaviour has in any way contributed to his illness then he could have a case for damages.

Employment law is a minefield and unless Rangers have been expertly advised I'd be amazed if they had followed the correct protocols.
Report akabula November 10, 2016 10:28 AM GMT
You can bet your last dollar Rangers did follow proper protocol.
Barton had a go at MW in front of players.
He admitted this following his first suspension and added he wouldn't be apologising.
It's his behaviour that would be deemed unreasonable.
The fact that the disciplinary procedure and outcome caused him stress wouldn't open the gates to a damages claim.

If Rangers could have sacked Barton they would have.

If Rangers could have kept Barton away from training they would have.

If another club had offered barton a way out he would have taken it.

Both sides will want out of this situation. The sticking point will be money.

By going off sick with stress Barton has done two things. He has positioned himself for the long haul and for a future IT.

3 issues with that.

1 They did keep Barton away from training.
2 Barton has got 2 offers to consider.
3 You've completely misread the last part.
Barton's ego couldn't handle the action Rangers took and he threw his toys out of the pram.
Plus he is now away having come to agreement with Rangers over a pay-off which is reckoned to be about 2 months wages.

Not sure where you are getting your info from but Barton was given instructions to obey which kept him away from all activities involving the first team squad.
As regards him claiming stress it is a nonsense to say that put him in the driving seat. It had no bearing on the treatment he received and merely highlighted he couldn't handle being disciplined.
Report akabula November 12, 2016 11:06 AM GMT
BTW him not being able to handle the stress wouldn't give him any redress against Rangers who only needed to comply with basic disciplinary procures.
With both a solicitor and an HR expert directors at Ibrox I doubt Rangers made any mistakes.
Report sageform November 12, 2016 11:20 AM GMT
Any other club that offers a contract to either Balotelli or Barton must be either deaf or desperate.
Report OnePercenter November 12, 2016 11:38 AM GMT
Are you saying Barton wasn't back at the training ground?

Are you saying you know for certain that all Rangers employees behaved within employment law at all times when dealing with this incident even before their HR dept and legal people became involved?

Are you saying you know for certain Barton could not possibly had any case against Rangers or any of their employees over this incident and their treatment of him?
Report akabula November 12, 2016 1:44 PM GMT
I'm going on the facts made known ie Rangers found fault with Barton's conduct and suspended him. Thereafter procedure merely states that Barton is given written notice of any meetings and copies of any notes taken in relation to his suspension.
I'm also going on the info Barton gave in an interview with Talk Radio immediately after his suspension. He confessed then he'd had heated words in the dressing room and added he wouldn't be apologising.
If Rangers hadn't acted properly then I'm sure he wouldn't have come to an agreement. As regards your final point what possible case could he have.
I've been involved in hundreds of disciplinaries over the years and a few where peep have used stress as a reason to delay procedures.
Given that Barton spoke freely at first I think it's safe to assume we'd have known of any other issues.
Report OnePercenter November 12, 2016 2:07 PM GMT
So you base your opinion entirely on hearsay and you are not at all certain all Rangers employees have acted within employment law at all times with regard to the issue. Neither will the Rangers' HR or legal teams be certain so they would be mad to let anything go to an IT especially as Barton would not be strapped for the price of a very good QC.

Rangers have paid Barton off when it has been pretty clear they did not want to. I'd say that was a result for Barton and he is now free to take up whatever offers come his way.
Report akabula November 12, 2016 2:26 PM GMT

That's laughable comment. Rangers wanted rid of Barton otherwise they would have lifted his suspension and played him. Laugh

Everything I quoted was either in the various Rangers statements or as spoken by Barton on Radio, how is that hearsay?
And to say Rangers wouldn't have known they were working within employment law at all times is a nonsense.
It isn't employment law that would be the focus but the companies disciplinary procedures.
Barton would have received a list of the companies procedures with disciplinary procedures a part of this.
Rangers only need adhere to their own rules to be within the law. Sop not sure where you are coming from on this matter.
Report OnePercenter November 13, 2016 2:41 AM GMT
Rangers clearly wanted Barton to leave without any payment. They wouldn't have been paying him when he was suspended but they would the moment he returned to training. The going off sick with stress put him in the driver's seat as Rangers were then going to have to pay him to sit at home (probably in England) hence the payoff.

All a sick line entitles a person to is Statutory Sick Pay which at about £90 per week wouldn't have been of much good to Joey.
Thereafter Company Sick Pay kicks in but as this a benefit and not a right it can be withheld if the employer feels the need.

Jailbird Joey's contract will be paid in full in three installments the final one being next summer. Due to the fact that his condition was leaked to the press Willie McKay was left with an open goal when it came to negotiations and he didn't miss. Sevco had such a weak hand they couldn't even insist on a non disclosure in the settlement so JB will be free to dish the dirt when he gets paid in full.
