have no idea at all of the relevance of your reply. civil law (the standard used by the FA) is on balance of probabilities, criminal law has a greater burden of proof. it is entirely reasonable for someone to be found guilty in a civil case and acquitted in a criminal one. Terry was acquitted of a criminal charge because there was doubt that the words he used (and he did, for instance, say "f***ing bl**k c*nt") were meant as an insult rather than (as he claimed) forming part of a question.
