No, it's against BetFair terms to bet below the minimum. Usually they lock your account for that.

Yes you can lay something with that low liability.
And yes a lay is a bet.

On this subject I have a question. Do lay with a value of € 5 and later to back with a value of 4 € and thus have a bet of 1 € violates the terms and conditions of betfair?

This lay/back is allowed, but it makes below value odds even worse because of the spread.
