Sales Job.

Basic and commission.

The company wants to increase the basic but reduce drastically what you earn in commission. They claim OTE remains the same and is uncapped (which it is) However most earn a lot more than OTE.

The whole commission structure is being changed.

It is a national company who want to trial it in just 2 areas not the whole sales team nationally, and see how it goes for a few months. Effectively most in the trial area will face a pay cut.

Is this legal? or would they have to offer voluntary redundancy if you do not agree?

Have you heard of the term "The American Way", well in ireland especially the big multi nationals are dictating employment law, so existing employment legislation is not worth the paper it is written on.

This american influence can be seen right across the eu where they have established business. Michael Moore did a pretty decent job on highlighting it actually.

In your case with sales I can't say,all I do know is that working in sales used to be a pretty decent job,but not anymore,I don't envy you mate.

Also the amount the basic is raising by is not guaranteed in phase 2 roll out.

I had a similar thing a few years ago where the Company cut our hours from 40 to 36 hours a week, but paid us the same money. But could claim that we had an increase in our Hourly Pay, which we did but were no better off. The thing was that they had to pay out overtime to get the work done and had to pay it at higher rate and 4 hours early then before. Swings and Roundabouts.

When I worked for a large life assurance company they done the same thing. Cut the commission and increased the basic and on the surface it looked a good thing; even the union said so, however; we were conned!

After all was agreed and put into practise this company revamped all of their policies and the end result (for me personally) was a cut of over £7k of earnings the following year. They knew what they were doing at the outset but based on existing policies it didn't look bad at all.

I suspect if you read your contract of employment, there will be something in there to the effect of..... "The company reserves the right to adjust commission payments as appropriate".

Pretty standard stuff. If you don't have your employment contract you should ask for a copy, as sometimes different employees have different contracts, depending on when you were employed. (Not all employers get round to standardising contracts).

Alternatively contact your Union, or if you don't have one, go to an employment solicitor, with a copy of your contract, and the new terms and conditions of course.

Good luck.
