The UK cannot block family members from outside the EU, but who live in the union, entering the country without a travel permit, European judges say.
The case centred on Spain-based couple Sean McCarthy, a dual British and Irish national, and his Colombian wife.
They argued she should be able to travel to the UK to see her British family without applying for a visa.
Patricia McCarthy Rodriguez claimed she should be allowed to travel to the UK with her British family without having to obtain a British visa as she holds an EU Residence Card issued by the Spanish government.
The British government has until now required Mrs McCarthy to obtain a "family permit" visa every six months if she wants to travel to the UK.
The couple argued their right to freedom of movement was being infringed.
The European Court of Justice, which interprets EU law, backed the McCarthys, saying the UK cannot demand that family members of EU citizens resident in the EU have to have a special visa to come to the UK.

Was a good idea when looking to promote trade between the members but has grown arms and legs since then.
Get it back to it's original aims or kick it into touch. |

dont think its just about promoting trade.
i think the deals in place help trade. we pull out we are at a disadvantage. saying that the uk does tend to bend over to rules compared to germany and france especially when there is some $$ to be made on the side for some... when it comes to proper decisions once again the policies are a mess |

They (UK Border)were Demanding that she applied for a Visa Everytime they wanted to Visit Relatives in the UK,
If a Brit wants to Reside in the UK with his Non-EU Wife, Then these rules Apply; Under rules introduced in 2012, British citizens who want to bring a foreign spouse to the UK must earn £18,600 a year and a further £3,800 - a total of £22,400 - if the couple have a child. Every year, you must show you have this amount in your bank Acc when asked or Prove you earn this amount, even before they will let your Spouse in. Many people who cant do this have to get Their Spouse in on a Tourist Visa. |

those rules look a bit gestapo ish.
if your even above minimum wage you are not always certain to be able to bring your wife back. luckily my misses is eu but if i fancied a bit of a columbian sort as a Brit it should be my right to be able to live with her in the UK |

Agree with court, if your married shirely you can bring your wife to uk without jumping through bureaucratic uk hoops every 6 months

If the Spouse of a British passport Holder is Residing in the UK, I Believe they have about 12 Months to take the English Language test, I am Not 100% sure on this,
But I do Know about a British Mans Wife who got Deported back to Ukraine for Failing to take this test (That Nobody tells you about) |
