Well known fact that 80% of victims know their assailant ( serious crime) and 90% of assailants either live or work within 500 yards of the crime-scene.

How on earth could it ever be proven if you have to prove what was going through the killers mind at the time?

If you take a deliberate action that is clearly going to result in death then that is murder .Wether or not the killer stopped to think about it beforehand is neither here nor there.

Manslaughter is surely when someone is responsible for the death but the action/or inaction could not be forseen as being fatal . The 'unsound mind' defence is very dubious when that comes up IMO but that was not the case here anyway.

Yes the Huntley is innocent juror was quite unbelievable. Judges sometimes don't explain reasonable doubt so well and some people get the idea that it means scientific proof.

I've done Jury Service a couple of times and people are happy to drag it out for another day off work tbh

The judge thought it would prejudice the trial, that the jurors would think he was guilty before the other evidence was heard.

I think thats dubious too .IMO if your defence was you were a decent chap and wouldn't commit this sort of offence then people are entitled to hear evidence to the contrary. Not sure Tabak had any 'character' defence though.

I don't think it was that relevant though as i just can't see how Manslaugrer can ever be a defence against murder by stangulation , as you just can't do that inadvertently, it is about the most deliberate way of killing people there is .Intent can never be in doubt.

exactly right - watching violent porn doesn't make you a murderer. Just read the judges reasons for not allowing it and it was that word for word.   Fair enough.

If you try and kiss a woman, and she screams, its not acceptable to start placing you hands with force around their mouth and neck. Then claim it was an accident when they die. - That should have been enough to convict him for murder.

yep it was so obvious that it was story concocted to try and fit the evidence against him. made no mention of it on his original police interview. the usual no comment answer to all questions which guilty people often do.

only when the tests came back showing his dna was on the body did he come up with this fairy tale.

I'm not sure it's right that it's withheld either but I do think it would undoubtedly be somewhat prejudicial. I'm no expert but you're not allowed to reveal previous convictions and such, are you? Huntley's previous was considerably worse than Tabak's in that regard.

surprised me too.  but apparently the judge didn't allow images found on his computer
(porn, incl women with men's hands around their necks) to be admitted to court.

don't undestand that either, this disgusting individual clearly had a secret double life,
if the jurors were allowed to consider all the facts sure it would have been
a 12/12 verdict. 

but maybe the judge confused some of the jurors with his directions
and telling them you have to decide did he intend to kill her.

on the face of it seems incredible they took best part of a month to charge a killer living next door. iirc boyfriend was the prime suspect even before tabak threw the landlord into the picture

I also think the notion that Tabak 'implicated' Jeffries, which the prosecution - at the behest of The Police no doubt- made a big deal of in court, didn't really stack up from what i read of the evidence.

While Tabak doubtless wanted to put the landlord in the frame, from what he actually said (landlord moved his car?) he didn't do a very good job of it and hard to say why anyone would rule out Tabak and focus on Jeffries just for that. 

I think the constant stressing of Tabak's lies re Jeffries are the police's first steps in trying to squirm out of what they did to the Landlord.

They gave no reason to arrest him at all!!

You would only arrest someone for this if you thought he had probably done it, not just because he looked a bit odd when they had zero evidence .They knew very well what the press would do with the arrest.

Of course no matter how incompetent they were the police will get an easy ride from the tabloids, who will hardly want to cover the mistreatment of Jeffries at all.

As to his hinting things, from what i recall at the time these were things his neighbour (not Tabak) said Jeffries has said which the neighbour (who was in his 80s) had got wrong.

Does not appear he ever came up with much of an alibi, and , apart from arresting Jeffries, other staements they were making indicated they were starting to look further from the scene of crime for a suspect.

Mr Jefferies is now pursuing a civil case against the police for wrongful arrest and imprisonment.

He complained: "The police were not interested at all in my well-being and, indeed, all they were interested in was making a quick arrest and being seen to be doing something effective in the eyes of the public."

The judge today was reported to have told the jury they had to be "sure" that Tabak intended to kill. Maybe some of the jury thought they had to be 100% certain when of course they only have to believe it beyond reasonable doubt.

In some cases it seems the jury don't understand reasonable doubt and the verdicts reflect that.

The parents of Jo Yeates said they wish their daughter's killer could have been given the death penalty.
In a statement read outside court by police on their behalf, David and Theresa Yeates said they hoped Vincent Tabak's life would be "a living hell"

Mr and Mrs Yeates said: "For us it is with regret that capital punishment is not a possible option for his sentence.
"The best we can hope for him is that he spends the rest of his life incarcerated where his life is a living hell."

The trial had been "more stressful and intense than we ever imagined", the couple said.
"There was never any doubt in our minds that Jo had been murdered and we fully expected [Tabak] to lie when he went into the witness box," their statement added.

We so miss hearing her happy voice and seeing her living life to the full”
"We came here with little hope or expectation of hearing what happened on 17 December but needed to see him and hear what he had to say first hand.
"We saw no emotion or remorse or regret for what he did to Jo. We felt all emotion expressed by him was false. All we heard were words of self-pity."

Mr and Mrs Yeates said: "We have still lost our daughter and our son has lost his sister.
"Our main sorrow is that Jo isn't allowed to start her own family, have children and achieve her potential.

"We will never get over our loss, how she was murdered and the total lack of respect with which her body was treated.

Miss Yeates's parents thanked people for letters and cards they had received, and for the physical tributes that have been made in commemoration of Miss Yeates which they said "touched us to the core".

I can't see how a juror could hear that it took 20 seconds to strangle the life out of her, yet be unsure Tabak intended to kill her.

This was one of the most chancer defences I have heard (because there was no better one) and the defence council still got two jurors to buy it. If I had my hands around your neck for 20 seconds squeezing the life out of you, could you honestly believe I only meant to shut you up in blind panic (in any circumstance).

Unless the two jurors misunderstood that the intent to kill had to be premeditated from the point he left his flat.

Following Joanna Yeates's disappearance the media and armchair detectives became fascinated by many puzzling elements of the case.

Most have now been at least partially explained:
The pizza

Yeates bought a pizza as she walked home on the night she vanished. The receipt was found at her flat but not the pizza nor its box. She had not eaten it.

The explanation: Tabak admits that he ate pizza on the evening he killed Yeates but denies it was hers. He claims he took the pizza and its box from her flat after killing Yeates and dumped it in a municipal bin. The prosecution suggested Tabak had eaten it.
The two bottles of cider

Yeates also bought two bottles of cider on her way home. This led to speculation she had bought one for her and one for a guest she was expecting.

The explanation: CCTV footage of Yeates in the off-licence was shown in court. She picked up one bottle of cider, stepped away, then returned and grabbed a second, suggesting it had been a spontaneous purchase and was for her. According to the defence, Yeates opened one of the bottles and may have taken a sip from it before she was killed.

When Yeates's boyfriend, Greg Reardon, returned home on Sunday evening he says he found the opened bottle and finished the drink. Tabak claims Yeates offered him a drink but he refused as he was driving later to pick up his girlfriend.
The sock

When Yeates's body was found one of her socks (in fact, one of Reardon's socks she had borrowed) was missing. One theory was that the killer had kept it as a trophy.

The explanation: Tabak claims the sock fell off in Yeates's flat and that after he moved the body to his home he went back to her flat, took the sock and put it in a municipal bin.
What happened to Yeates after she vanished?

There was a great deal of speculation following Yeates's disappearance and after her body was found. Was she held captive before being killed? Is that why her body was not found for eight days? Was she left alive by the side of the road in sub-zero temperatures to die of hypothermia?

The explanation: both the prosecution and defence accept she was killed soon after arriving home on the night she was last seen alive, and her body was dumped in a roadside verge not long afterwards. Fresh snow fell and covered her body, and few people walked along that lane.

The jury system is a joke.People being judged by a set of morons in most cases.I did 2 weeks of it and was amazed by how thick some of the people were.This guy was guilty no doubt and the right decision reached in this case,but I think cases should be dealt with by judges.The days of 12 people good and true should be ended.

The jury system needs to go. A lot of trials are complicated and full of legal jargon that you are going to get some people just doubting the evidence.

Many juries are too easily confused and a good barrister can create doubt in their minds when there really should be none. Quite how anyone can believe you can throttle and strong young woman to death by mistake is a mystery. Judges as well are often too far up their own arses to sum things up in a way a jury can understand.

I think that the time is coming when something must change.

There are cases where the Internet and social networking are jeopardising trials. And in other cases where complex science is used in evidence or expert testimony debated that very few people are in a position to judge, however intelligent they might be. Is the average judge in any better position to weigh up expert testimony or complex science than the rest of us?

I rather like the idea of a set of people debating the evidence, rather than having one, perhaps no better-informed, person deciding the verdict. It probably needs tweaking a bit for the times imo.

Apparently Tabak's ex is believed to have moved abroad to start a new life.
She met him through the Guardian's lonely hearts column, Soul Mates in 2008.

Poor girl was so convinced he was innocent she went into shock
when she realised he was responsible.
She said they had planned to marry and start a family.

His ex gf (assuming she has dumped him!)is the silent victim in all this.

It must have been an appalling situation for her to realise that the person she had planned her future with had done such a thing. She won't get a huge amount of public sympathy because she is not seen as the victim and she will always be associated with Tabak regardless of the fact that she was absolutely nothing to do with it.

I wouldn't wish that situation on anyone and hope that she manages to start afresh. I reckon I would struggle to trust anyone after that.

Disagree with the call to drop jury trials on here, particularly with some of the reasoning.  It is true that a "clever" barrister can cause doubt in jurors, but we have a tough standard of proof for criminal trials - you have to be _sure_.  If doubt can be created that easily and created in six people out of twelve, then guilt isn't proved imo.

An American prostitute has claimed Vincent Tabak tried to strangle her weeks before he murdered Joanna Yeates.
Sarah Rayne, 22, met the Dutchman in a hotel room while he was in Los Angeles on a business trip last December.
Miss Rayne says Tabak paid her £155 for sex and then asked her to act out a fantasy in which she pretended to have been drugged by him while he squeezed her neck and "throttled" her.
“At first I played along with him. But then squeezing started to turn into throttling. I screamed at him to let me go and he must have been so shocked by my shrieking that he did.”

“I told him to leave and he had the nerve to ask for his money back."

Tabak is expected to ask for a move to Holland at the earliest opportunity.
With no family in the UK and a mother who is ill, he will qualify for a move under international prison transfer rules.
But the final decision is down to the authorities.
A spokesman for the Ministry of Justice has refused to comment on individual cases.

It means he won't be considered for release until that point - 20 years.

To be honest, I doubt very much he's killed before. The stuff with the prostitute would suggest he was building up to this, and his attempts to cover his tracks after the murder looked amateurish. He'd have been caught sooner were it not for the snow.

Vile images of children being sexually abused were found on Vincent Tabak's laptop, police sources have revealed.
An anonymous officer involved in the investigation said Tabak had 30 images depicting child pornography on his laptop computer at home. They were all category four images.
'Following his conviction for murder, I don't think the CPS (Crown Prosecution Service) will prosecute. It just won't happen.'
There are five levels of severity for offences involving indecent photographs of children, which start with images depicting 'erotic posing with no sexual activity'.
Category four images depict penetrative sexual activity involving a child or children, or both children and adults.

Courts should have the power to quiz all defendants and witnesses on their use of internet porn said a top lawyer .
Nick Freeman the solicitor dubbed Mr Loophole said it was outrageous that the jury in the Jo Yeates murder trial couldn't hear about Vincent Tabak's interest in images of women being throttled - yet Milly Dowler's father was hounded over his interest in bondage when his daughter's killer was in court.

Mr Freeman  said: 'In my view, anyone watching internet porn should know that if they subsequently become a defendant or witness in criminal proceedings, their cyber spectating could be open to questioning in court, if relevant to the charge.'

There are 755 million porn-heavy pages on the web, generating £60billion a year in filth-soaked revenue. And nearly 36 per cent of the population are looking at it. One of them could be you.

The Attorney General is considering whether to take action over a tweet exposing Vincent Tabak's use of violent pornography.
A blogger is alleged to have ignored a reporting ban during the trial of the Dutch engineer for murdering Jo Yeates.
The suspect was arrested last week over the tweet, sent out before the jury delivered its verdict.

SY - there's a fair chance that ultimately they would have obtained DNA from everyone who lived a certain distance from Jo Yeates's flat, and that would have seen Tabak fúcked.

Vincent Tabak's trial over child porn charges has been postponed


THE trial of an engineer accused of possessing and making indecent images of children has been postponed.

Dutch-born Vincent Tabak, 36, was due to stand trial on Monday at Bristol Crown Court accused of four charges of possessing an indecent photograph or pseudo-photograph of a child and two charges of making an indecent photograph or pseudo- photograph of a child.

Tabak, right, formerly of Clifton, was charged following the discovery of indecent images of children which were allegedly found on his computer following a separate police investigation.

The possession charges are said to have been committed between 1 January 2009 and 5 January 2011 and relate to material allegedly recovered from a laptop. The making indecent photograph charges relate to images allegedly found on two external hard drives in Bath and Bristol on 23 April and 29 July 2009 respectively.

After an application to delay the trial for further expert input, the trial date was postponed to a date to be fixed in the future.
