just a quick one for anyone who can help

i have a business which my employee is now buying off me
we have agreed a price , we have agreed a date and come to an agreement re outstanding cashes owed by customers
to cover himself he has asked for some sort of letter or contract of sale , i have drafted something up and he is fine with this after a couple of points were added /ammended , we are on extremely goos terms and there is no prospect whatsoever of me ripping him off and im 99% certain of the same from him

questions - any document i draft and we both sign in front of witnesses , are they legal or at least enforceable should there be a problem
is there some sort of pro forma contarct available
is it worthwhile seeking a solicitor to do all of the above

cheers

offer and acceptance makes a contract.obviously there are many grey areas, so best advice is definitely get a solicitor

business is a van based one so buildings wouldent be a problem
main concern from me is a % is being held back as agreed to cover certain things which will be paid after month 1 and obviously written into the contract - i am pretty sure it wont be an issue but you never know

thats the point, no matter who it is you can never know for sure.
i fell out with someone who had been my best friend for many years over something that amounted to about a grand, we hardly spoke since.

above poster is correct.a year ago a very good mate was one day away from having his house repossessed.i gave him a part time driving job earning £175 a week for 2 hours a day.i pay the money direct to the mortgage company.he started off ok but he's now the biggest nuisance i have got, always late or blobbing.moaning whinging and whining and making mistakes all over the place.if i get shot of him he will probably lose his house and 3 guesses who the villain will be

the buyer has worked for me full time for 6/7 months now and has been fine , he has basically run my business for me whilst i have been 250 miles away pursuing another venture , he has had ample time and opportunity to rip me off but has been straight down the line and has just got an inheritence and asked about buying the business - 85 % will be upfront and the remainder will be sorted after a month when i have had the van MOT`D . that month i also have the opportunity to get any cash outsanding to the business so it suits me as well
anyone know wether or not the agreement would stand up in court should there be a problem

All depends how much involved Mandy ,take in to consideration solicitors

fees and the time it would take to recover any losses anyway ..and

the added time to sort it all out ..
