a friend who works with me, had her car parked outside her house.
the police chasing a crook caught him and threw him against her car and in the process of arresting him caused a fair bit of damage to her car.
not wishing to affect her no claims bonus she thought the police insurance would pay for any damage they had caused, but now they have sent her a snooty letter along the grounds that she should be proud of the good work they do, and that she should claim off her own insurance.
does anybody know where she stands on this matter?

claim off your comprehensive insurance- they will do the rest if someone is legally liable
end of story.

I'd be very suprised if that was the tone of the letter,in fact v suprised indeed.

The O/B dont make it particulraly easy to claim when they have made damage aressting/apprehending someone etc but they do have a pretty standard set of procedures and the letters they send out are a standard legal few paragraphs.

It wasn't her fault so the insurance would pay out as the police must have endless of incidents like this.

would she lose her no claims bonus if she use's her insurance company to get the police to pay out, as they do not appear to want to pay out without a struggle

Tell the police your sending the letter to the press. That should be the end of it.

======
That is totally correct .
Even if you are 100% in the right .

that is why you pay to "protect" your NCB.

This is factually incorrect,as i have claimed through my own comprehensive insurance when it was a third parties fault. providing the full cost is recoverd from a third party insurance you won't lose your no claims bonus. FACT !
Report niceone • January 5, 2010 1:36 PM GMT
Ok. Get your friend to make a claim against the police through their own insurance. The insurance companies will decide who will pay between themselves.
Report orioles • January 5, 2010 1:37 PM GMT
On the facts as you present them, the police are liable for the damage to your friend's car.

Nick a lorry and plough it into the local nick.

You'll get 6 months for criminal damage but refuse to pay the repair bill to the police station.

That'll show 'em.

Claim on police insurance ... if in fact they have any ?!?
Report V4 Vendetta • January 5, 2010 2:39 PM GMT
Tell them you want to make a complaint that they left the scene of an accident.
Report thebrain_01 • January 5, 2010 2:45 PM GMT
i used to work in insurance, to be honest i didn't read your first comment properly, i assumed your friend's insurers wouldn't deal with it but they are the first people to call. their job is to claim against the 3rd party who has damaged your friends' car, in this case that is the police. the above statements are correct in that if they make a full recovery of the costs you will not lose any no claims bonus. she will have to pay her excess though but that can be recovered once the claim is settled. if the insurance company struggle...some are useless!!!! then it may be worth trying one of the many legal companies out there. I could name one but would rather not on here but do your research as they're not all there just to take your money.

As the mighty O says the police WILL pay you long as you send them the appropiate letter and detail any damage

Someone murderers stopped in my old hotel few yrs back and police wrecked 4 rooms doing finger prints forensic and cost 2k to clean up and had to be pretty blunt though they did pay.

BC, I know a few solicitors' firms that would have sent you a hamper every Christmas :)

They would have had to send it to you courtesy of the local nick, but they'd have loved you nonetheless!

Police forces have departments set up for claims. (Finance and Resources)
For example when effecting entry to premises damaging doors etc.
1/ Make a complaint about conduct of officer making arrest
2/Make complaunt about organisation if that truly was the tone of the letter.
3/Obtain quotes written ones for cost of repair.
4/ Submit quote with complaint. It is not a job for insurance.(Request timescale. Police forces are judged on these things)
You will be paid in no time

Report TEN2FOLLOWER • January 5, 2010 5:32 PM GMT
She should write to her MP.

The police would roll over and cough up then.
