A few journalists looking into the test certs that he gave the aussies now. Aside from the dodgy story about the tests and not isolating it seems they've done an amateur job in making them look legit and the dates and sample numbers don't tally. Looks like his negative test was done before his positive and the positive was done 26th Dec and then backdated to 16th. Initially the positive test QR code when scanned showed a negative and this was changed to positive shortly after this was discovered. The results website has a timestamp built into the URL address and they forgot to change that and it tallies with the above dates.

It seems likely that he has both lied and committed fraud/forgery here. The Aussie Minister can revoke his visa and has a very good reason to now. It is not a given that he will be banned for 3 years on top of that but he would have good reason to ban him too. It would not be good for the tournament or future tournaments and the future of the AO generally if he does that. But if the media keep pushing this it will be very hard for the Aus govt to ignore.

Tennis Australia seem to have gone AWOL. Not only did they lie to Djokovic about what constituted a medical exemption but seems they may have falsified his travel documents. God they must have been desperate to have him in Melbourne.

Who says they have to get involved in anything? The Minister has discretion to revoke his visa. He can look at all this and the failure to isolate and join the dots if he hasn't already. Only going to happen if the media keep the pressure on tho imo.

Don't agree with Navratilova equating being out of a tournament for pulling a hamstring with Novak's situation.

If you're injured you're not potentially going to win the event, if you're fit and ready to play but sent home for political reasons then you're not being allowed to win the event.
(thus the eventual 'winner' is only effectively winning the 'without Djokovic' market. IMHO!)

But the die is almost certainly cast now, we shall see. I just want to see the man play.

What he did was rash, going to an interview and breathing the omicron on a journalist's face. Of course that is the case, he knows it's the case. Ana Brnabić has made it clear he'll be disciplined Serbian style when he gets home for the rash behaviour.

But it shouldn't be relevant to whether he plays in the event when he has won his court case. It's two separate things.

While Djokovic could still get the chance to compete in front of "amazing fans", Breen is reporting the Serbian could be removed from Australia before the end of the tournament due to the timing of the chaotic saga.

"There is word the government will cancel Novak Djokovic's visa today – and that will lead to this scenario," Breen wrote on Twitter.

"His legal team will file an injunction, which will be heard tomorrow.

"Djokovic will be drawn to play in the Australian Open as top seed.

"Injunction will be granted. Case heard next week.

"He will then play, meaning he could be thrown out mid-tournament if court upholds Immigration Minister's decision.

If he was thrown out today then going by the timescale Neil Breen's calculated he would play what 3 or 4 matches once the injunction was granted and the case was being heard.

From a betting point of view this would obviously have opened up interesting opportunities for players in Novak's quarter.

However that doesn't seem to be happening.

If he was to lose a match before Hawke makes his decision that would solve the issue of having to throw him out mid tournament.
I'm not suggesting anything that crazy is what they're hoping for here, but at this stage anything is possible.

Djoko prob doing a lot of damage to the antibody status v vaccine status argument.

Looks like he wasn't positive in Dec and won't want to prove it through a test, if he was he could prove he had covid has  antibodies and doesn't need vaxxed and is not a health threat but it won't go down this road.

It has been steered away from natural  resistance from prior infection for a while now with no real proof of antibodies from vaccine either.

They want another level of control via vax passport, just a backdoor ID card.

Odds novak had covid in Dec are very high imo.

He must of been promised it wouldn't get challenged.

Hope he can recover mentally and get back on track as looks like it's over here, what are rules for his travel to France/UK/USA????

To my thinking if you can prove via a test you have antibodies then I don't see why a vaccine is needed,expecially for elite sports people.

Fitter than a butchers dog, the risk from vaxx to risk from covid changes imo, fit people under a certain age should never have been jabbed, kids as well, no way.

Anyway best for punting if novak is either in or out, maybe nae use imo.

A couple of fairly relevant updates from Chip Le Grand's report for The Age

Djokovic’s fate, which will be decided by the Federal Court on Sunday, no longer turns on whether he should have been given a medical exemption to play in next week’s Australian Open and whether, on the basis of the documentation he had, he should have been allowed to cross the Australian border.

As far as Immigration Minister Alex Hawke is concerned, those matters are no longer in dispute. In a stunning series of concessions that form part of the government’s high-stakes legal strategy, Mr Hawke accepts that Djokovic has a medical reason for not being vaccinated, came here with a valid exemption and posed a low risk of either getting or passing on the virus while in Australia.
He has abandoned all grounds on which Djokovic’s legal team had amassed a mountain of scientific and other evidence – all of it still untested – on which to defend his right to stay in this country.

If it is inclined to take Mr Hawke’s concessions at face value, Tennis Australia may even be tempted to claim vindication.
It can point to the fact that the minister now accepts that the decision of its independent medical panel to award Djokovic a medical exemption on the grounds of a recent COVID-19 infection was consistent with the Australian Technical Advisory Group on Immunisation’s guidelines.

I (perhaps thankfully) have commitments the next few hours. This case will turn on whether Djokovic may increase anti-vaxx sentiment given his high profile. There’s a strong perception he’s an anti-vaxxer but, problem is, he is not. I trust the court to view it dispassionately Folded hands

Wood has pointed out that Novak's most recently expressed views include that

1 - admits he is no expert
2 - he has an open mind about it

Lloyd (for govt) is focussing on what Hawke is entitled to infer as a response to Wood pointing out that Novak's current position had not been sought out.

The word 'infer' being used repeatedly.

Pointing out Novak is not vaccinated as of January 2022.
Lloyd says 'It's open to infer that Novak could have been vaccinated if he wanted to be / the minister is entitled to assume that it was his choice.'

Says he fact that he may change hie mind one day doesn't make the minister's inference invalid.

Lloyd says Hawke's concern is Novak fostering anti-vax sentiment not just among anti-vax community but all Australians.

Interestingly Lloyd now broadening Hawke's concern beyond anti-vax to anti-mask behaviour (ie when Novak went on Instagram to talk about his regret that he didn't cancel the interview with the L'Equipe journalist after testing positive).

Adds that Hawke inferred that Novak's presence in Australia would cause people to emulate this anti-mask behaviour.

Points out that people use high level athletes to promote ideas and causes. Says we're not inferring Novak is actually 'advertising' this behaviour but his connection to a cause has a comparable effect.

Absolutely. I think it's wild.

I was assuming this would come down to a mix of the legal and the political.
I didn't in a million years think that after Novak winning the first case and the visa being revoked again they would just concede the legal side and suddenly rest everything on demonstrating what Novak's views are (based on inference without consulting Novak) and what effect this would have on the Australian public.

Lloyd finished up by saying the minister is aware that there are consequences for his decision and that Hawke is aware of unrest, effect on good health and good order, and was aware of the protest the day after court's decision.

Refers to 'this notion of Political issues. This is not a minister that is not thinking the consequences of a cancellation decision or a non cancellation decision.'

Lloyd saying Novak would have to establish that if Hawke considered the thing he did not consider (consulting Novak about his current views) then there would be a reasonable possibility of a different result.

Lloyd saying that Hawke had taken a broad spectrum of considerations into account (eg public health, good order, potential for protest in response to a decision)

Also saying there is no evidence that Novak would have said anything that would have made a difference if his views had been sought.

Lloyd saying if Novak won the Open it's an example for young and not so young fans of tennis.

Lloyd refers twice to vaccination rate being low in Serbia. Refers to Novak having become an icon for anti-vax groups.

He adds that in the same way that Novak associates with a whole range of products which does well for those endorsements. Rightly or wrongly he is seen to endorse and anti-vax view and this is what leads to the healthcare consequences.

'The knowledge of his perceived, historical and unanswered views could be seen to contribute to those issues.
That is all that is required for the minister to make the inference'

Unreasonableness can be used to depricate the process by which a process was reached.

Assuming for the purpose of discussion that his decision might galvanise antivax activity. As soon as you accept that the minister had clearly identified this and linked this appropriately to the public interest. If one attributes awareness to the minister of the BBC article it becomes perverse/unreasonable for the minister not to do something with that awareness.

Basically, because of this fast approaching #AusOpen deadline, the court plans to basically say today/tonight if Djokovic has won or lost his appeal, and then at a later time they would articulate specific reasons for that decision.

If Novak loses he's out of the Aussie Open. From what I understand this being a full court the decision can't be appealed (that's why Team Djoko wanted to move on from just one judge, because those decisions can be appealed). But I don't know if there's some loophole around that or that Hawke can just cancel his visa again.

Serbian president launches extraordinary attack on Australia over Novak Djokovic legal battle - accusing officials of 'Orwellian performances' and Scott Morrison of 'mistreating him due to elections' (Daily Mail Australia)

The president of Serbia has lashed out at Australia after national hero Novak Djokovic lost his 11 day legal battle to stay and compete in the Australian Open.

The unvaccinated tennis star will likely fly home in a few hours, prompting his nation's leader Aleksandar Vucic to accuse Scott Morrison of playing politics ahead of an upcoming election.

Mr Vucic accused Australian government lawyers of 'lying' during 'pointless' court proceedings when they stated less than half of Serbians were vaccinated.

'You saw in the pointless court proceeding how much the prosecution lied,' he said.

'They are simply lying. They say there are fewer than 50 per cent vaccinated people in Serbia and officially the number is 58 per cent.
'Don't forget that's higher than in many European Union countries. That was a pointless argument, but that's possible in Orwellian performances.'

Mr Vucic said Australian athletes would be treated better when they arrived in Serbia for an athletics event in March and 'and we won't mistreat them due to elections.'

The president said he had given Djokovic his full support and told him he 'could not wait' for the tennis star to return to Serbia where he was always welcome.

'To mistreat the best tennis player for 11 days, and on the 11th day hand him the decision made on the first day…' he said, Serbian publication Novosti reports.

'Thank you to the Australian people as I am sure they love Serbs. They think they have humiliated Djokovic, but they have humiliated themselves and he can return to his country and look everyone in the eyes with his head held high.'

Serbian Prime Minister Ana Brnabic echoed the president's sentiments when she said it was 'unbelievable' two different court decisions had been reached in 11 days.

Ms Brnabic said over this time Djokovic had endured both 'physical and psychological mistreatment' and said she welcomed him home.

That's the thing Giuseppe.

The whole show turned out to be political, it's just that initially the mask of potential rule breaking was used and then the mask was just whipped off.

Just in the same way that a lot of posts on forums/social media about Novak have masked basic xenophobia with 'he broke the rules' until that was no longer a useful mask.

My appreciation for Nick Kyrgios has increased. When the chips were down he dropped his usual schtik and went to bat for his colleague. Unlike some he understood that sometimes there is a time to look beyond personal preparation.

Oh and I hope Nadal goes out in the first week.

Recently having covid isn't a valid medical exemption - Tennis Australia are the one's to blame, they aren't the Border Force.

i haven't been following this as closely as some have, but i'm pretty sure the court ruled his visa was valid did it not?

Hawke accepted

2 - Djokovic came here with a valid exemption
3 - Djokovic posed a low risk of either getting or passing on the virus while in Australia

In the original case the concession by the government's counsel was that the decision to proceed with interview and to cancel visa was unreasonable in the circumstances.

Djokovic was not adjudged to have had fair opportunity to process what was happening and to give a complete response.

Hawke was being kind in not pursuing the lie on the visa & "medical exemption".

He knew the decision would stick.

The judges even said, they didn't concern themselves with the reasons, only that Hawke's action were legal.

Can someone enlighten me as to what condition an elite athlete would have that mean they can't have the vaccine? my son has congenital heart defects and has had the shots. Glad we can look beyond the circus show now and watch some tennis.
