Yes this case is a disgusting miscarriage of justice and heads and pensions should roll imho. There should be a Judicial Enquiry.

I read that Starmer was the DPP at the time they ruled that a retrial would be too expensive. I'm not that familiar with the case, but they were involved after the other man's DNA sample was established.

GMP oversight is with Labour party, I believe.

This happened when Labour were in gvnt.

So not much they can pin on the Tories. But, we can be sure that the guardian will try to find something.

selection needs to be looked at. So much corrupt
practice about.

It's actually amazing police are ever trusted there
is so much evidence of bent cops.

But a truth finding exercise would help, but

The cops, the CPS and the CCRC were professionally inept, morally weak and corrupt. They had the evidence to acquit him but were too weak to admit their mistake and release Malkinson.

Then the state charged him for bed and breakfast for 17 years at HMP.

Malkinson was identified by the victim in a identity parade line-up, despite several key details not matching with the description of the perpetrator. For example, she described the attacker as being 3 inches shorter than Malkinson, with a hairless chest and no tattoos. Malkinson had chest hair and prominent tattoos on his forearms. She also said the attacker would have a "deep scratch" to his face, since she'd scratched him so hard she had broken one of her fingernails. Malkinson was seen at work the next day with no scratch to his face. He also didn't have the Bolton accent the victim said the attacker had.

In 2020, the CCRC turned down another application from Mr Malkinson, again failing to make any forensic enquiries.

After APPEAL commissioned DNA testing which revealed the presence of male DNA which could not have come from Mr Malkinson in several other samples from the victim and her clothing, the CCRC in 2022 finally arranged a search of the National DNA Database.

This linked the DNA from the vest top to a new suspect, ‘Mr B’, who was subsequently arrested by police. However, Mr B’s DNA profile had been sitting on the database from 2012 – meaning the CCRC could have identified him as a suspect years earlier.

Despite having the legal powers to do so, the CCRC did not obtain and review the police’s case files – meaning it failed to uncover the disclosure failings which the Court has ruled renders Mr Malkinson’s conviction unsafe.

If the CCRC had uncovered the disclosure failings and referred Mr Malkinson’s case to the Court of Appeal in 2009, when he first applied to the body, he would have been spared a decade of wrongful imprisonment.

It's hard to believe a decent barrister could not
highlite the obvious absurdity of the identification
of malkinson given the fairly clear evidence given
by witness in initial statement.

It's like West yorks police going down a rabbit hole
looking for the mackem hoaxer instead of the ripper.


It does rather beg the question.. Why did they fit
him up!

Hairless chest

The man is olive-skinned, in his early to mid-30s, and of medium build.

He has a flat stomach and defined chest muscles. He had a shiny hairless chest, was clean-shaven and spoke with a Bolton accent.

He was wearing dark trousers and a white shirt with a collar, which he wore unbuttoned.

Witnesses or those with information about the attacker should contact Salford CID or ring Crimestoppers.

This man stayed in jail for 10 extra years because he would not admit he was the rapist just so he could get out quicker.

I really believe that people should be jailed, lose their pension or at the very least lose their jobs over this.

What sort of person does not care if the wrong man goes to jail?

Very very strange altogether. Even with the numerous failings.

Detective Inspector Steve Bell said the e-fit is a very good likeness to the attacker, according to the victim.

He said: "Since the start of this investigation we have had very little information put forward by members of the public. I am hoping someone may recognise this man.

"This man would have come home in the early hours of Saturday morning with a scratch on the right side of his face and neck.



The victim was apparently able to provide extremely detailed descriptions, but picked out someone else in a video line up. Obviously it sounds like a horrendous and traumatic experience.

The CCRC has now reviewed the evidence and allowed the case to be referred to the Court of Appeal, where judges will decide whether to allow an appeal against the conviction. In a statement issued by legal charity Appeal, Mr Malkinson said: “I am innocent. Finally, I have the chance to prove it thanks to the perseverance of my legal team at appeal.

“I only have one life and so far 20 years of it has been stolen from me. Yesterday I turned 57 years old. How much longer will it take?”

Advancements in scientific techniques have uncovered traces of DNA on the victims clothing which allegedly match the 48-year-old from Exeter. The charity said that the new analysis of the DNA was only possible because samples had been kept by the government-owned company Forensic Archive Limited, and accused Greater Manchester Police of having destroyed or lost exhibits.

The CCRC has passed the DNA evidence to Greater Manchester Police for investigators to consider.

CCRC chairwoman Helen Pitcher said: “The new results raise concerns about the safety of these serious convictions. It is now for the Court of Appeal to decide whether they should be quashed.”


It was only through the persistence of this charity. Everywhere you look, you find more stink. Who will pay, likely nobody, aside from the taxpayer.

gmp and the ccrc have repeatedly shown themselves to be clowns in this particular miscarriage of justice.

witness identification evidence is notoriously unreliable, as this case highlights.

shocking case.

Read about this a few weeks ago.

What I couldn't figure was why the police had him as a suspect in the first place, in order to put him in the line up.

Baffling how she picked him out.

Very difficult to get any part of the system to admit an error, even when it is clear.

It smacks of the post office postmaster style cover up (on a smaller scale). Rather than admitting errors, allow innocent people to rot in jail.

weeks earlier and recalled his appearance, visited him at his place of work on 20th
July 2003, only hours after the offences were committed. He had no visible injury to
his face. He was arrested on 2nd August 2003. From the outset, and when
interviewed under caution, he denied the allegations. He agreed to take part in
identification procedures and to give DNA samples, saying that scientific evidence
would show his innocence

one witness was a junkie who only identified him six months later, another one changed her mind at the id parade. they both had plenty of form which wasnt disclosed to the defence.

the victim scratched the attacker in the face yet malkinson had no injuries on his face.

photographic evidence was withheld.

it is a litany of c0ck ups.

Regarding the identification, a couple of years ago in America
a best selling author Alice Sebold  apologised for her part in the wrongful conviction
of a man who was cleared after spending 16 years in prison
Her first book described how she saw a black man in the street who she believed
was her attacker . Anthony Broadwater was arrested and convicted . Her first book lucky
described the events and sold a million copies , her most recent The Lovely Bones was
turned into an Oscar nominated film
When she was attacked she was an 18 year old university student in New York
After his arrest Ms Sebold failed to pick him out in a police line up selecting another man
But he was tried anyway

The Luke Mitchell case is the one which should currently be filling the void created by Malkinson's release.
A shocking and quite orchestrated frame up by the Dalkeith and L and B police , aided and abetted by Newspaper brainwashing of the general public,  of an innocent youth who happened to fit their bill.  With no concrete evidence whatsoever. And that is no disrespect at all to the poor girl who was brutally murdered.  May she rest in peace.
